10 Commandments statue must be removed from state Capitol, Oklahoma Supreme Court rul

    "OKLAHOMA CITY (AP) —A Ten Commandments monument on the Oklahoma Capitol grounds is a religious symbol and must be removed because it violates the state's constitutional ban on using public property to benefit a religion, the Oklahoma Supreme Court ruled Tuesday.

    The court said the Ten Commandments chiseled into the 6-foot-tall granite monument, which was privately funded by a Republican legislator, are "obviously religious in nature and are an integral part of the Jewish and Christian faiths."

    The 7-2 ruling overturns a decision by a district court judge who determined the monument could stay. It prompted calls by a handful of Republican lawmakers for impeachment of the justices who said the monument must be removed". - Source

    As legal decisions come and go these days, there is nothing special about this one, it follows the familiar pattern set decades ago in reference to the placement of religious icons, representations and statuary on public grounds; which is a violation of the Establishment Clause and Free Exercise Clause. Also familiar is the rights reaction to this, calling for the removal of justices who disagree with them and of course, appealing this decision to the federal courts.

    As this is a state supreme court dealing with a states constitution, I just don't see it going anywhere.

    Meh, the 10 commandments as a whole weren't compatible with our laws to begin with anyway. They criminalized freedom of religion, celebrated punishing a child for the crimes of its parent and declared thought crimes illegal.

    If the legislature does not like a court's ruling, they can simply pass a law specifically contravening it.
    The power of the court actually derives from the legislature; it is the legislature who has delegated out powers. (The only exception being certain special powers granted by the State's Constitution, but these are usually rather vague)

    A court has no power to enforce decisions if the legislature revokes its power to do so.

    Where do the Ten commandments advocate punishing a child for the crimes of it's parents?

    They don't advocate humans doing it, they just celebrate God doing it. It still runs counter to our country's concept of justice and individualism, favoring instead the Biblical doctrine of corporate guilt.

    The 10 Commandments come from Exodus 20:1-17 and Deuteronomy 5:4-21. The commandment against creating idols (which is incompatible with our Bill of Rights) also contains a celebration of corporate guilt.

    "You shall not make for yourself an idol, or any likeness of what is in heaven above or on the earth beneath or in the water under the earth. You shall not worship them or serve them; for I, the Lord your God, am a jealous God, visiting the iniquity of the fathers on the children, on the third and the fourth generations"

    Hmm.. I wonder how many of the Ten Commandments were made into US laws?

    You shall have no other gods before Me. - 1st Amendment overrules this
    You shall not make idols. - Ditto
    You shall not take the name of the LORD your God in vain. - Ditto
    Remember the Sabbath day, to keep it holy. - Nope,
    Honor your father and your mother. - No
    You shall not murder. - YES!
    You shall not commit adultery. - No
    You shall not steal.- Yes
    You shall not bear false witness against your neighbor. - Yes (Slander/Libel)
    You shall not covet. - No. If this was a law, Apple and most other corporations would be out of business.

    So 3 out of 10. Wow, that's some influence on American law. </sarcasm>

    we are a nation that values free speech, we do not support blasphemy laws... thus blasphemy laws have no business being placed in gov buildings

    The Ten Commandments a CHILD COULD COME UP WITH!!!

    They are ovious beyond belief.

    We can't allow every religious Group even if they are part of State Gov. to be allowed to place statues or reliefs of any Religious Inonism with State or Federal Buildings because that means EVERYONE AND EVERY RELIGION would have to be allowed the same right.

    SATANISM is a listed estabished RELIGION in the U.S......so would you want a Statue of Satan in a building?

    The powers of the courts, legislature and executive derive from the U.S. Constitution and State constitutions. A legislature cannot alter the judicials power merely by passing a law. Such a change must come at the constitutional level, via amendment or convention.

    Actually, the Satanic Temple did create a statue to put on the front lawn of the Oklahoma Statehouse.

    Shouldn't be there in the first place. I don't mind little placards like they have in the US Senate, no one is going to die from seeing that but it sounds like this is a big monumen of some kind.

    And this is why NO ONE GROUP SHOULD BE ALLOWED TO DO THIS!!!

    You allow in one group then you have to allow every other Religion to be able to do the same!!

    Secular nation, I agree the 10 commandment's probably don't belong there.

    That looks like the type of belief/statue that would make threats.

    Ever wonder why a Holiday tree or Christmas Tree's are allowed?

    Because they are a PAGAN PRACTICE!!

    People were cutting down trees and decorating them a thousand years in advance of Christs birth.

    You are right. The case was decided on ''independent and adequate'' state grounds and will likely be dismissed in federal court. SCOTUS has ruled on this issue several times --- against the display of the Big Ten.

    Thou shalt not murder... yet Oklahoma can impose a death penalty. Seems the state didn't abide by them anyway.
