I saw this article the other day and was annoyed by the reporter's headline and lead-in. They made it seem like they were punished for burning the flag, per se.
In fact, these students burned another person's flag, on their property, and that was attached to their house. In that case, the charges of arson, reckless endangerment etc are all legitimate. If, on the other hand, they had burned a flag at a political rally or something, then there should be no consequences. (Sadly, I bet there are people here who disagree. If this applies to you, read the 1st amendment and Texas v. Johnson)

Having said that I still have the right to think for myself. I also have the right to consider the burning of an American flag for any reason as wrong, wronger than wrong - you go and read the 1st ammendment !!!!

Sure, they have a right to burn a flag. They do NOT have a right to burn something that does not belong to them. If this is true, I think they should throw the book at these jackholes.

Chill out F100, I was just saying in my post that the article I read on the subject was misleading. In the situation at hand, they committed multiple crimes that should be punished, but the fact that an American flag was burned is inconsequential in the legal sense. I also think it is "wrong" to burn the flag, and you have the right to say so. However, it is "wronger" to make it illegal to do so; it violates the basic principles of our government. I'm trying to make the distinction between what you and I think and what the government has a right to enforce. No need to quote the 1st amendment. I know it, and the next 9 amendments by heart.

The act of burning an American flag in America is, at the same time, a dramatic political statement and and affirmation of the very thing that makes America worth defending.
It may be the most poetically efficient expression of political free speech extant. Love it or leave it. |
