I don't speak for everybody who finds fault with treatment of women under Islam, but I believe the main concern rises from legal inequalities that exist between genders, whereas in western culture, inequalities exist only on a societal level. Society is fluid and flighty, and we hope that perfect equality exists in the future, whereas legislature is only changed consciously.
Also, about the capitol punishment for rape, quite apart from that being to great a punishment for the crime. There is a good reason that victims and relatives of victims do not have legal authority during the prosecution of their wrong-doers. They will always demand greater punishment than is just, and it is not a double standard, but emotion that causes this. Secondly, capitol punishment is completely irreversible, whereas a prison sentance can be terminated at any time. If more evidence surfaces after the convicted criminal is killed, showing the criminal to be innocent, then that "criminal" was put to death wrongfully. If this happens to someone in a prison, they can be released and live out the rest of their days no worse for the mistake.

Mere deterrent is not enough to rid the world of rape and the complications of rape make punishing it a challenge to the fairness and rule of law that Western democracies stand for. Rape is a behavior based on a culture of misogyny and that creates control-freaks. It should be dying, but it is near impossible for the police to deal with those that do it and most of the time women do not even report it. There is no obvious solution other than to attempt to destroy what remains of a culture that considers women subservient and that drives men to desperately seek control over them. And I'm not even sure we know where to begin. The reason Islamic countries in general have done well is due to near universal acceptance that rape is a dishonorable act, looked down upon by God even if not seen by Man. But as Pakistan shows, even the religion itself is not sufficient to bring an end to a culture that allows rape. Rape, much like domestic abuse, permeates in America not because of our laws but because too many of us turn a blind eye and deny that it happens.

The problem with rape isn't the punishment, but the prosecution. Rape is punished with many years, even life, in prison, which for Americans is a big deterrent.
The trouble with prosecution is: 1) It is hard to prove beyond a reasonable doubt in court. And to lessen the criteria would undermine our whole justice system and lead to the potential for innocent men to be imprisoned. 2) Women tend not to go to the police out of a sense of guilt and fear that they will not be believed. Sometimes they shower before going to the police and inadvertantly remove the evidence. These things have a cultural cause. 3) Rape usually occurs without witnesses and much like domestic abuse, when it happens and the perpetrator is someone we know, we deny it and block it out. The only way to stop rape without the potential for more injustice is to turn society to a stronger stance against it and to encourage men to condemn rapists publicly and women to not feel guilty when they are raped. And as much as it sucks to have to say it since women are not responsible for being raped, it would help if women were educated on how to avoid rape and given some training on self defense.

The hijab doesn't magically prevent all wearers of it from being molested. Give me a break. And the only reason you can sit there and say that rape only occurs in Saudi Arabia once every five years is because the number of women who report rape in Saudi Arabia is extremely low.
And a woman should be allowed to walk down the street, any street, NAKED without being inappropriately touched by anyone. If a man rapes a woman, it's his fault, period. He's the one with the inability to control himself. End of story. |
