The woman in Cali is an idiot. Rape is a serious crime, and the laws already make distinctions between statutory rape, for example, and aggravated rape. Leave well enough alone. Or if you really want to make a change, then make the rape of children a capital offense. But then, that seems to offend the liberal justices on the Supreme Court. More idiots.

If the woman and the man is drunk, then I do not consider it a 'rape' as such. If the woman chose to drink, she chose to get drunk, and she must accept part of the responsiblity.
I don't think men should be expected to control their body's when they are drunk, and the woman can carry on like a pork chop and expect nothing to happen.

Totally concur.

at a college orientation programs at the university i used to attend, first-year students were taught that if at any point the woman involved in a sexual encounter is intoxicated it is automatically "gray-rape" by the man involved--even if he is intoxicated, too. even the smallest smidgen of alcohol in the blood was seen as coercing consent.

Note that I never said anything either way about whether or not the woman bears any responsibility for the situation. However, as a man, I say that a man should have enough brains to remain sober enough to be able to figure out whether the woman is sober enough to know what the hell she is doing if/when she invites him to bed. If the guy is stupid enough to have sex with a drunk female, and if the law in his jurisdiction decrees that a drunk female is incapable of offering up her consent, then so be it if he gets charged with rape.
