A little over a month ago I was let go as a substitute teacher at a High School for telling a kid this exact quote "I've asked you numerous times to keep down and stop being so flamboyant. Consistently throwing your hands in the air, stomping your feet, and making a scene isn't acceptable.". Little did I know the student was a homosexual and I actually believed the girl he was with was his girlfriend. I was subsequently fired the next day 1/3 of the way through the day for saying the word flamboyant. Was the school justified in letting me go? Was it right to not educate the child the word flamboyant has a meaning besides homosexual?
You should talk to an attorney. I guarantee when you file that lawsuit, the entire nation will be looking into this, not just this forum. - - - Updated - - - I hope you're being sarcastic.

Also I'd like to point out that someone confirmed with Vice Principal that let me go that the kid was indeed acting flamboyant and I was doing my job. The word FLAMBOYANT was used to describe his actions and the VP agreed that he was acting FLAMBOYANT not any other word... but FLAMBOYANT.
The good news is, as the Radical Lefties, emboldened by Obama, continue to push out acts like this over and over and over and over and over... Sooner or Later, every middle class, politically centrist person is either going to become personally, or have a close friend or loved one destroyed by the Leftie PC Fascism. At some point, a vast majority of Americans will learn to absolutely hate and mistrust the Lefties because this kind of PC gotcha politics. Additionally, the country is already going bankrupt. Unfortunately that cannot be done through legal means due in large part because I was an "At Will" Employee which makes disposable at any moment without any reason. The reason I mentioned filing a lawsuit is because it's official and gets everyone's attention. If what you say is true, and I have no reason to believe it isn't, I'd like to see you being interviewed by Megan Kelley or Greta on Fox News. Things like this shock the senses and tend to go "viral".

Wrong. She was fired, therefore she can sue; she has standing in court. The school may try to have the lawsuit dismissed, but once it's filed, it becomes public.....like Fox News public.

Flamboyant is not a word one uses to describe someones actions unless its meant to describe gay people so yeah. They were justified in firing you. Bet you wish you had a union.
A sub is a temp worker, there is no expectation of any work beyond that day. The only standing she could have is if she weren't paid for the day she worked part of, and that's not big money. It's small claims, not a lawsuit.

I know about subs, as a former teacher. They aren't on contract, and as the OP said, it's an at-will position (see post #11). You can be fired for any reason at all. No lawyer in their right mind would take the case, and if they did, it would be an example of an abusive lawsuit. Yes, you can sue for almost any reason, but sometimes it's just stupid to do so. This is one of those cases. Subs are temp employees, with no expectation of future employment. It's just common sense. I'm a conservative, and I see that. Yes, it was wrong that they fired the OP, but it would be hard to show damages.
If the story as you've related it is complete and true, I think it's a stupid reason to have been fired.
