    No he wasn't a visa overstayer.. Universities are sticklers about student visas.. When he finished his course work in Hawaii he transferred to Harvard.. Where do you come up with such crap?

    This is one those fuzzy issues with the Constitution. The Supreme Court of course "interprets" the Constitution whichever way the wind blows and they are not constitutionally authorized to define "natural born citizen" anyway. Aside from that, the quote in Minor v Happersett says that all children born in a country of parents who are citizens are natural born citizens and there's no doubt about that but what it does not say is what other characteristics might also designate a natural born citizen (if any). The problem with the quote is that it only points to one type of natural born citizen and doesn't include or exclude any other possibility.

    This quote should be the driving factor IMO:

    And the problem is the actual debates were never recorded other than on paper and not everything was recorded. So who knows what the founders really intended in terms of "natural born citizen"?

    Don't have to.. You are refused admission unless your student visa is in order.

    Do you understand the statutes? Obama's father was under US jurisdiction because he was in the US.. Its just that simple.

    There is nothing "fuzzy" about it. He doesn't have the vocabulary or basics to even read the statutes.

    Nation mean citizen.. What kind of "national".. a US national or a foreign national?

    Jurisdiction has NOTHING to do with allegiance or who your father is.. It means US law prevails in the US.

    Natural born and citizen at birth are identical in meaning.

    Naturalized is when a foreign national is granted US citizenship.

    In this state of things, on the 15th of October, 1872 (one of the days fixed by law for the registration of voters), Mrs. Virginia Minor, a native born, free, white citizen of the United States, and of the State of Missouri, over the age of twenty-one years, wishing to vote for electors for President and Vice-President of the United States, and for a representative in Congress, and for other officers, at the general election held in November, 1872, applied to one Happersett, the registrar of voters, to register her as a lawful voter, which he refused to do, assigning for cause that she was not a "male citizen of the United States," but a woman. She thereupon sued him in one of the inferior State courts of Missouri, for wilfully refusing to place her name upon the list of registered voters, by which refusal she was deprived of her right to vote.

    It doesn't matter, and it will vary per individual. To be an effective deterrent to foreign influence, the constitutional clause needed to be a combination of (jus soli) "right of soil", and (jus sanguinis) "right of blood"; and that's exactly what the founding fathers enacted.

    Born on US soil (right of soil), to citizen parents (right of blood); a "natural born citizen".

    Jus soli is a Latin term that means law of the soil. Many countries follow the system of jus soli or more commonly known as, birthright citizenship. Under this concept, citizenship of a person is determined by the place where a person was born. Jus soli is the most common means a person acquires citizenship of a nation.

    Another system called jus sanguinis is when a person acquires citizenship through their parents or ancestors. The U.S. follows the jus soli system to determine citizenship. What this means is that whoever is born in the U.S. and is subject to its jurisdiction is automatically granted U.S. citizenship.

    The Fourteenth Amendment, codified that judicial authorities recognize that the philosophy was integral at the conception of the country’s constitution.

    You see the British has this thing under "Common Law" known as "natural born subject."

    Get real, nobody with a lick of sense will argue that an infant abroad experiences as much foreign influence in three months as a teenager who has spent all but a year of his life abroad.
    Then surely explaining why the Naturalization act of 1790 didn't require the former* for natural born citizenship won't be a problem.

    * It's hard to make the case it even required the latter, by your two-parent definition.

    I've lived in four states, yet my heart still rests with the state I was born in. As I said, it will vary per individual, and as I said, it doesn't matter. It doesn't matter because "born on US soil to citizen parents" is both a jus soli and jus sanguini deterrent to foreign influence. Which is the greater influence is irrelevant.

    The Naturalization Act of 1790 has as much relevance to the "natural born citizen" clause as the US Code of 2018. In other words, it has no relevance at all. Did you know the 1790 act was so flawed that it was later repealed? You can't begin to understand the "natural born citizen" clause until you get your head out of the Congressional code. It's like trying to draw water out of a dry well.

    If you can't, you may as well join in with Margot, and believe that every type of citizenship created by the US Code for the last 230 years represents the Constitutional definition of a "natural born citizen".

    Couldn't say back to the USA because they never were on American soil.

    So how does someone break a countries law when not on that country's soil ?

    I was referring to the clause in the Constitution, not a poster in this forum. The Constitution is supreme to any statute by its own mandate.

    That's a no. Congress does not have any constitutional authority to interpret the Constitution, neither does SCOTUS (despite their illegal assertion in Marbury v Madison) or the President.

    This thread is all about the usual bigots wanting to promote one of their favorite memes "birtherism", under the guise of the clearly dishonest cover of a "theoretical discussion". This fig leaf serves the purpose of allowing them to go on at length about a long discredited meme and pretend that it has validity.

    The focus on Obama's birth certificate, two years AFTER he left the White House is a clear indication of the underlying bigotry, and the core anger that the talk radio white right feels over the fact that a black man ever sat in the White House. I

    It is also one of the major drivers of Trumpsterism, a fact that Trump panders to constantly by still going on about his predecessor and his constant race baiting.
