Except that when it came to the valuation, he also gave different numbers for occupancy in the same year. It's common to use market value for, say, a loan application and accounting value for taxes, but occupancy is occupancy. If he's telling the banks and investors that 90% of the units are occupied and telling the IRS that only 50% are occupied in order to claim a more substantial loss, that's likely tax fraud, bank fraud, or both.
