Federal Judge Raymond Dearie repeatedly chided the former president’s lawyers for refusing to provide evidence to back up Trump’s claim [ That trump declassified the documents].

... Dearie seemed skeptical. He told Trump’s lawyers on Tuesday that if they will not actually assert that the records have been declassified and if the Justice Department makes an acceptable case that they remain classified, then “as far as I’m concerned, that’s the end of it.”

 

What difference does it make for him to perform his job? He can still act as if they are classified.

 

Dearie said that if Trump couldn't prove his claim that he declassified the documents he would have a rule which means Trump will not get the classified documents they will be returned to the government.

As for the other documents the government isn't so concerned about those it's all about the classified documents

 

The crimes for which The Stain is being investigated have nothing to do with the classification of the documents...

No, but the urgency of state's access to them is greatly enhanced if they are to be treated as classified and it will definitely impact decisions on whether to seek other search warrants and a more agressive response by the judiciary.

Yep that way the DOJ can claim they are classified after the fact, an impasse, when they should have sent trump a specified list identifying which files he had that they wanted back. I can see where his attorneys are coming from. If they knew trump had classified documents they would have had to have known which documents he had that were classified. For trump this strategy put him on very thin ice. It will be interesting to see how his attorneys will handle this, it appears they figured it out but how to proceed in court like this is dancing through the eggshells time.

It's up to the DOJ to prove Trump didn't declassify the documents so why would Trump want to help the DOJ prove it's case? I'd make the DOJ work for the evidence and stall as long as possible. The Orange Stain is being investigated under 3 federal criminal laws that relate to him illegally taking and holding high security documents and then lying in order to obstruct justice. His culpability is not dependent upon whether the documents hold any particular classification.

If there was anything truly important in these documents they wouldn’t have waited all this time to barge in and grab them suddenly.

Apparently Trump's legal team doesn't give a **** about any documents that have a classified label attached. Those can be addressed at a later time. The reason why a Special Master was appointed was to determine what documents belonged to Trump. This isn't rocket science. Separate those personal documents from those that are PR.

Neither should Dearie be concerned about them. Why he's sticking his nose in an area that is no concern of his is odd.
