    If the documents are labeled classified Dearie doesn't have to recommend they be returned to Trump. Any other documents could be.

    correct, that is all the special master is doing, so if Trump doesn't provide any proof, they will be considered classified

    Anyway, that will be determined by forensic examination.
    The one Trump stopped with his antics.
    But will continue at some point.
    Then we'll know, maybe not the content but the severity.

    Just because a document is labeled classified doesn't mean it is still classified.
    FYI, if it is labeled Classified, it is required for it to be treated as classified. One cannot change the procedure just because some info in the past was marked classified and later found not necessary. Even while unnecessary, it is still classified, until it is changed, period.

    Of course.
    First they have to determine if the classified documents are real, then do a damage assessment. If real, they will be sent to the appropriate departments for an assessment of what hazards were potentially exposed and maybe have to make changes to head off potential threats, and produce a risk assessment report for the DOJ.
    No matter what happens trumps antics are costing taxpayers millions, his supporters millions in attorneys fees, and potential hazards to the security of the United States.
    What a stable genius he is!

    Other posters have addressed this question, yet you continually repeat it.

    That aside, your assertion about whether a document is over classified does not in any way change the classification markings. Your reference to the POTUS procedure is irrelevant.

    If they bring criminal charges, they will have to prove that the documents are still classified AND that Trump mishandled them, AND that the mishandling was INTENTIONAL.

    They'll never carry that burden of proof,
    Losing would wholly vindicate Trump, therefore,
    I expect no such criminal charges.

    Take for example the presidential schedule for upcoming travel. Prior to the travel, it's highly classified and so marked. After the trip is over, it's common knowledge though the original documents will continue to carry the stamps until someone removes them.

    If the government charges Trump with mishandling classified information, and they won't, because they will lose if they do, they will carry the burden of proof that:
    1. The documents WERE classified.
    2. That Trump KNEW they were classified.
    3. And that Trump DELIBERATELY mishandled them.
    They'll never make the case, which is why they will lose, and Trump will never shut up about beating their fake charge. They will never be known for anything other than LOSING to Trump, which is why they will never bring the case.

    But, we have massive raids of Trump, with no criminal charges, clear criminal activity by Hunter, with no raids. When DeSantis takes over the Executive Branch, like Bill Clinton did, he will likely need to fire just about every single Federal Prosecutor and bring some folks in that have a working knowledge of equality before the law.

    The 11th Circuit Court already ruled that the classified status of the documents was a red herring - that the real subject was that Trump lied to the FBI
    about all the documents being returned, and before that claiming he wasn't aware they were there in the first place. Obstruction.

    As to the Hunter Biden stick - send him to jail or not - that has
    absolutely NO legal bering as to the Trump case. You are trying to argue that
    a bank robber can't be taken to trail because some other bank robber
    2 years ago wasn't charged with bank robbery.

    Show me a doctrine that specifically states "the President will..."! I guarantee there is nothing because everyone has just assumed the constitution gives the president the unilateral authority to declassify information as he/she sees necessary. This unprecedented accusation on Trump mishandling classified information will eventually bring about clarification but Trump will not be grandfathered in. This will end up tying the hands of future presidents to do their job protecting Americans. Government is all about more red tape.

    BS, all the previous Pres were able to do their job as such, none ever even came close to such illegal behavior. If national security causes a little red tape, then so be it. The procedure is in black and white !!!!
