Lawyer John Eastman wrote out this six-step hairbrained scheme to get then VP Mike Pence to overturn the election.

I highlighted nothing in the document so that you will read all of it, but here are some immediate takeaways:

-Kudos to the lawyer for thinking out of the box, even if what he proposed was illegal and would very likely have lead to a real civil war.

-the claim that 7 states "have transmitted dual slates of electors to the Senate" is an out and out lie. Both before and after safe-harbor day and then for sure after the casting of the electoral votes in the respective states, there was only ONE slate of electors for each state and DC. That is fact.

-Notice that the lawyer picked seven states: That is 2 more than the 5 states that Biden flipped in 2020. The five states that were most contested by the Trump camp were: WI (10 EV), AZ (11 EV), MI (16 EV), GA (16 EV) and PA (20 EV). That's 73 electors. Biden beat Trump by +74 electors, the missing elector is from NE-02. But keeping NE-02 out of the picture for just a moment, that would have gotten Biden down to 233 EV, but the lawyer claims in his scheme that Biden would be at 222 EV, so we need to find 11 more EVs.

There is no state that was heavily contested that had 11 electors, but had the lawyer meant NV (6 EV) and NE (5 EV), there's your 11 electors. He could have also meant NY (6) and NH (4 EV), which would only be 10 of 11 electors, and maybe he screwed up his math. The Trump team was never known for getting things mathematically right.

So or so it is moot because as said, there were no dual slates of electors that were actually approved by the respective SOSes of the states. The duly elected slate of electors had long been transmitted to both Houses of Congress and even more importantly, already to the congressional archives (as proscribed in law).

What the document does is to show what lengths the Trump team was willing to go to in order to effect a coup since they didn't like the results of the election. They were willing to quite literally pull out all the stops (sorry, organists of the world) in order to stop history from flowing forwardly.

But there is one more detail, one that is far more perfide, and that is the coincidental timing of the debate over the electors from Arizona and the sudden storming of the Capitol at 14:14 on January 6th, 2021. In light of this document, did others outside of the Trump conspiracy cabal know of this plan and were waiting to be triggered into action in case Mike Pence would not be willing to simply set aside Arizona's electors? Or had they simply been instructed by Trump's minions to wait on a signal from him like "let's all march down to the Capitol!"??

These are questions that the 1-06 committee in the HOR will surely look into.

The brazen, naked illegality of all of what this lawyer proposed is... mind boggling, down to declaring the Electoral Vote Act to be.... lol..... unconstitutional.

I am so very thankful that this truly horrible man, who never should have been President to begin with, was booted out of office by the voters, fair and square. And it's time for some on the Right to stop the big lie and all the little lies. Enough is enough. If you don't like Democracy this time because you didn't get your way, surely there is room for you in, say, Russia.

It appears that these guys thought that they could actually pull this off.

 

There are some typos in the OP, notably I meant NV and not NY (6 EV). Also, I meant that there was no OTHER state with 11 EV that was contested. AZ (11 EV) was of course hotly contested but already in the math.

It’s called a scenario. Written before 1/6 so there are no lies like your comment about states sending dueling electors. In fact much of this was discussed at the time in the media.

I am not surprised. Trump only hires slimy critters like himself. Maybe Pence can use this for a defamation suit and attempted <whatever the hell the people that said "Hang Pence!" were trying to accomplish>. Trump's Big Lie destroyed his political career and he and his family have been moving around in hotels and with family due to death threats.

This lawyer may even be charged with something and hopefully disbarred.

And, now, we have the 2020-Election-Gate document. No wonder Trump was projecting so much. He was up to no good (as if some of us needed a pdf to confirm it). He was no good pre-presidency and he's worse post-presidency because he keeps subjecting us to his nervous breakdown. Most people just quietly slink away to a psychiatric hospital for some happy pills. Trump crashes weddings and sends weekly memos of his brain diarrhea.

 

Of course it was written before 1/06 but long after safe harbor day and long after the electors cast their votes in mid-December 2020.

Get your facts straight.
