    In general, you can not sue the FDA for damages from a drug or procedure that is subsequently determined to be defective or dangerous.

    I'm reasonably sure that to do so would require identifying some sort of malfeasance on the part of the FDA.

    So, no, I think it is incredibly rare that this post of yours is correct in any way.

    We certainly do allow lawyers to troll for cases like that, though!

    The CDC has branches that do studies that the FDA relies on. There is one being done by a CDC affiliate concerning ivermectin right now.

    Under FDA requirements and monitoring, Pfizer has successfully completed phase 4 of testing of their vaccine for the age group they targeted. That is what led to full authorization of the Pfizer vaccine as formulated, within the age constraints for which their testing applied.

    Now, they are expanding the target age group and that naturally requires additional testing.

    Never said anything about suing the FDA, just pointing out that the things they have approved ended up killing people. Like Roundup. You can sue the manufacturer, however. Do not use FDA approval as a declaration of product safety.

    The FDA IS a product safety organization. That is their whole job. They don't have ANY other job. They do a DAMN good job, too. There isn't any other US organization that comes close to what they do, though there are organizations that do watch specific issues and hold stronger safety guidelines on those issues. For example, there are organizations that watch water quality and have show serious reasons for decreasing lead content in water below what is allowed by US law.

    Monsanto/Bayer are being accused of not warning customers of knowledge that they had concerning the link between Roundup and cancer. That was a malfeasance, thus justifying a lawsuit - which may or may not be successful.

    That falls within the guidelines I commented on in a post to you.

    I'd add that one of the most serious problems faced by the FDA is the constant gutting of their monitoring and enforcement that is the result of the assault of the Republican party.

    The FDA relies on Pharma for studies of drugs. The CDC is a revolving door between government and Pharma. The recent panel that just approved EUA for Pfizer for children includes current and past Pfizer executives.

    Imho, this is a problem throughout our government. I'm strongly in favor of slowing that revolving door, but moves in that direction routinely die in congress.

    Of course, congress has the same revolving door problem. Especially in states with term limits, legislators are more focused on their next job than their current job. That's one of the serious problems with term limits - it ENSURES that constituents are not the issue anymore.

    On the other hand, we're talking about Pfizer vaccinations here, and I do not see evidence of this problem in this case.

    Frankly, this is where I thought you were going.

    You are struggling to promote a conspiracy theory. And, the objective is to **** can the entire FDA, replacing it with ... nothing.

    The problem with your conspiracy theory is that the FDA is NOT the only game in town.

    You have to also **** can NAIAD, WHO, CDC, and the rest of the major institutions of science based medicine around the world.

    You have your work cut out for you on that!!

    I have seen no evidence of improper decisions being made wrt monitoring of Pfizer.

    The one think I've really hated about the process with Pfizer is that Trump demanded that Pfizer gets full and total patent control of their vaccine, even though public money paid for it.

    The result is that the US is seriously hamstrung in helping other nations fight this disease.

    Pfizer did not accept federal funding to help develop or manufacture the vaccine, unlike front-runners Moderna and AstraZeneca.

    What are you claiming about this tweet?

    It's also true that German citizens made a huge contribution.

    The point is, Pfizer was NOT on its own in a freemarket world. They got gigantic help.

    And, I believe that help was warranted.

    My main concern with that is the subsequent determination that Pfizer gets to block moves by the US to help huge sections of the world who can not help themselves.

    The partnership was paying for the vaccine once it was delivered. The US paid zero for development.

    That doesn't comport with what Pence said.

    He said that "thanks to the partnership of Trump and Pfizer" the vaccine is effective.

    It was HIM taking credit for his administration ensuring the vaccine is effective.

    That doesn't include anything about manufacturing or "once it was delivered".
