    What is grasped is that McGlockton chose to initiate unwanted, violent, physical contact. That is ultimately all that matters as far as the law of the united states is concerned. The first to initiate physical violence does not get to be the victim.

    Don't think for one hot minute that the shooters prior behavior won't be a factor in deciding his guilt or innocence.

    I find it kind of funny. First, you all were adamant that he would not be charged. Now that he has, you've moved the goalposts to wherever it is you've moved them to.

    Once he's convicted of manslaughter, or worse, what will your argument be then?

    This is the US... innocent until proven guilty in a court of law. The case is going to court.
    But, you can feel free to continue to advocate for a lynching... a cure far worse than the disease.

    He killed a man for pushing him on his a$$, actually acting as judge and jury and doling out the death penalty, but I give my opinion and you claim I'm advocating lynching him? That's really rich

    I heard a story of an old man in my neighborhood. He's very limited because of his age. He needs a wheelchair. He still has a shotgun because he was a former hunter.

    One night he heard burglars in his home, so he grabbed his gun and killed one suspect. The other two burglars fled. The man was charged with manslaughter but was acquitted. The court said he had no other way to stop the crime because of his physical limitations.

    It was not a push, it was a shove. It was felony battery, thus assault under the law of the state of Florida. And the law of the state of Florida is quite clear when deadly force may legally be used.

    It’s sad that anybody would have to go to court to defend themselves after their home is broken into, especially by multiple people. An able bodied person is physically limited in that case.

    The defender must use the mildest means to prevent a crime. If he throws a hand grenade against a little boy trying to steal his bicycle, he pretty sure goes to jail.

    Commonsense. If someone is stealing your bike you don't get to shoot him.

    There are different laws in different countries, what is allowed to fend off an attacker. Here in Germany we have "Notwehrexzess" (self defense excess) as an offense. Sorry, can't give you an english source that describes it.

    Ah, didn't realize you were in Germany. As you say, different laws for different countries. In the US there are different laws for different states, and even for some cities in those states.

    I think the problems that some Americans would have with this limitation is that you can't be sure if the mild form of self defense you use would be effective, and the penalty for failure falls upon the victim, not the perpetrator.

    Self defense was not specified. It could be a threat against your person/body, or as he said a boy stealing a bike. That's a bike, as in any bike.

    In the united states, especially in states that recognize the standard of the castle doctrine, deadly force is legally justified for the purpose of self defense is a reasonable person believes it is necessary to prevent either death, or great bodily harm being committed against themselves or another.
