He entered as a trespasser with intent to steal. Without the police questioning and searching Arbery as the McWilliams tried to detain him for there is no way to prove that beyond a reasonable doubt but there are certainly RGTS. In the car showroom scenario it would be entirely the same.

 

They DID have an immediate knowledge, Arbery's appearance and actions gave them that and linked him to the felony of burglary. They did not have evidence to PBARD, to justify an arrest and conviction but they certainly had RGTS

Btw, the original DA’s stepped down because they personally knew the perpetrators and had advised the police to not even be brought in for questioning. Those same DA’s are now under investigation as well as the local police department.

It's why they are charged with murder, aggravated assault and attempted false imprisonment. They had zero legal authority to detain Arbery, as you've been shown.
