    This is the intellectual dead end of declaring the fetus is a person.

    And the devaluating of all human life is the dead end of viewing a fetus as anything other than a human being.

    So every pregnant women who drink, got drunk, got in a car accident, the baby is dead, should now be arrested for murder? No wonder AL is considered such a backwood, backward state.

    No court will side with this. The prosecutor haven't decided to prosecute either.

    It applies by being a statement that there are situations for which deadly force is warranted. Is such being denied on the part of yourself?

    And where are the citations to demonstrate others present were doing everything in their power to try and prevent or otherwise stop the assault from continuing?

    An unverified account by an individual who was likely not even present at the scene of the incident.

    It is not the law of the state of Alabama. Rather it is a matter of federal law.

    No individual is allowed to preemptively utilized physical violence against another. Whoever initiates the physical confrontation with force has surrendered their ability to claim that they are a victim.

    Did I not say that your statement is true? What you did not answer is how that relates to the situation being talked about.
    Probably the same place that has the citations that the shooting was justified
    Do you have anything (police, anything) that disputes the claim?
    Do you have evidence of PHYSICAL violence was preemptively used?

    It went beyond that with the death of the child, that is a homicide.

    The DA hasn't decided on a charge yet although he should give great deference to the citizens grand jury. The Constitution establishes them for a reason.
    Women have been charged nationwide under such circumstances. Perhaps it is you state that is so behind the times that it thinks babies only become human after they are born.

    What is the standard of care a pregnant woman must maintain to avoid prosecution? Does she have to quit work if she has a condition that might harm her fetus? What about her diet? What is her obligation to pay for medical care during her pregnancy? Must she avoid travel? If she does travel, should she avoid particular modes of transportation? Could she lose her passport if there is evidence she would obtain an abortion in, say, Canada? Could she be prosecuted if she obtains an abortion in Canada? What if the pregnancy is a threat to her health? What circumstances might justify her ending her pregnancy? Who decides? What if the pregnancy is an immediate threat to her health? Is the "morning after" pill illegal? What about other abortifacients used to treat other conditions? Is she required to limit her use of certain prescription drugs? What about over-the-counter drugs? At what point is she obliged to test for pregnancy? Is she doesn't test as required? And on and on.

    As I said, an intellectual dead end...

    Expecting people to die defenseless totally stupid and extra sad.

    Only one thing worse than a criminal dying during the course of a crime, well two things
    1. The death of a bystander
    2. Someone being victimized by a criminal.
    In this instance both seem to have occurred.

    Are you sure you have this straight?
    Lady A's baby daddy may have something on the side with Lady B and Lady A gets pissed and sees her on the street and gets out of her car to confront her. Now, in your mind Lady A is now a "criminal" but also defenseless while Lady B is the "victim".

    And his mind would be correct....especially legally.

    1. "B" did not approach "A". "A" approached "B". That makes "A" the initiator and aggressor.
    2. If "B" felt her life was in danger of death or bodily harm because of the actions of "A", she has a right to protect herself without repercussions from the law. Depending on the laws of the State, this could even mean using a legally registered gun.
    3. If an innocent life is lost because of the aggressive acts initiated by "A", then "A" is the responsible party, even if "A" did not intend for the life to be lost. If the State's laws transfers these rights to the unborn, then the unborn are treated exactly the same as if a living person was standing beside "A". For example, if you ran a red light and caused another car to swerve......and they ran into a 3rd car driven by a pregnant lady....and the baby is lost, you could be charged with manslaughter for running the red light.

    Because A initiated violence against B. Since A was not married, the father of the child is under no legal obligation to refrain from engaging in extramarital affairs with B or anyone else. Even if such an obligation was present, A still cannot initiate a violent confrontation with B under any circumstances. The only way for A to be a victim, according to united states law, is if she is physically assaulted first.
