Yea I would say the smart play would be to force Mueller to justify a subpoena if he wants to talk to Trump. Then when he Mueller cant do so that would be a strong indication that there is no more justification that the probe itself continue.

DiGenova specialty these days is promoting conspiracy theories as a pundit on fox, not trying cases in court. So trumps legal team has lost a court oriented lawyer, and gained a lawyer whose specialty is bombast. IMO, this signals that there is less plan to confront mueller in court.... and instead a plan to try the case in the court of public opinion... remember when the election was “fixed”? Now we will have a message that the investigation is fixed
I've been saying since day one Mueller will be "investigating" until 2024. Trump should take a meeting and then sit there on his phone ignoring Mueller. Then he can invite him back and say "no no, this time we'll talk don't worry" ...and then ignore him again. See how many times Mueller believes Trump wont take the football away.
And it was just reported that the House "investigation" failed to investigate many connections between Trump and Russia. They avoided what was most potentially damaging to Trump and quickly ended the game without the Democrats on the team knowing, and published the "report" that did not included the input or participation or even the knowledge of the Democrats on the team, and so cannot be called a "committee report". IOW they just worked to exonerate Trump and his gang. Validity wasn't important to them.
