Every one of these gay cake cases, the complaining party was able to go down the street to another baker and get the cake thay wanted. Do you really think avoiding this arises to a "compelling interest". Is avoiding a minor inconveneince to gays really such a governmental interest?
I see the myth of abundant alternatives has arrived, as if they existed everywhere. Some of us know differently, having lived in places where there's only one bakery in town, and where driving to the next town over wouldn't necessary yield success, either. In the end, the case may be decided on the issue of what is or is not speech, whether or not it's compelled speech, and whether the burden on a fundamental right is too great, despite the compelling interests forwarded by anti-discrimination laws. I tend to think the baker will prevail. But I wonder how long then before gay people lose what few protections we have, and we have to return to living in gay ghettos in big cities, or end up forced back into the closet and sham hetero marriages if we want to live and work anywhere else. You think that can't/won't happen? I think it's extremely naive to think so, but people rarely want to confront the nightmare reality they're helping to create for others, whether through their own prejudice or simple apathy.
I believe that it "won't" happen, yes. Anything "can" happen, especially if we wait long enough. But I can't think of any civil right accorded to any significant group that has ever been rescinded. Not even the Republican Party proposes rescinding Title 7. Republican Chief Justice Roberts considers Roe v. Wade settled law. And they can't repeal the post-Civil War Amendments, even if they wanted to, which they don't want to. Obviously there will always be disagreements about how far they reach and what exceptions apply.
Gays should not have special rights, period. Homosexuality is a private business it has nothing to do with race or marriage.
No one asked about wedding cake, the cake was on the shelf (or inside the oven) the homosexual activists asked baker to join homosexual party Homosexuality is your private business, no one is obligated to follow the rules that you established in your private company. Why should baker should change his brain and start thinking as homosexual, that is totally beyond my understanding.
I was referring to "Every one of these gay cake cases" IN THE REAL WORLD, and not in the hypothetical you have imagined.
The case was decided in favor of the plaintiffs; the cake shop was ordered not only to provide cakes to same-sex marriages, but to "change its company policies, provide 'comprehensive staff training' regarding public accommodations discrimination, and provide quarterly reports for the next two years regarding steps it has taken to come into compliance and whether it has turned away any prospective customers." Masterpiece appealed the decision with the aid of Alliance Defending Freedom, and refused to comply with the State's orders, instead opting to remove themselves from the wedding cake business; Phillips claimed that this decision cost him 40% of his business. Regardless of your feelings on gay marriage, do we really want commissioners telling small business owners to "change their policies" and "provide quarterly reports"? Seriously?
No, don't want them fined for 100s of $1000s of dollars either. Its absurd. T-girls case is one of the worse cases. Bar owner actually invited the tgirls(transsexuals) club to hold their meetings at his bar and did so willingly. But then his other business started dropping off. Women customers complained about all the dudes in the bathroom. Male customers thought the place had become a gay bar and they were looking for the company of women. So he ASKED that the Tgirls not hold their meetings there any more. Had it instead been the ladies quilting club, a local soccer league, the Shriners, a motorcycle club, ANY group or organization other than the T-girls, he would have been well within his rights to ask them not to hold their meeting there at his bar. BUT since the group involved one of the favored classifications of people, transsexuals, hes fined $400,000 dollars and run out of business. Sick of purposeful discrimination in the law, claimed to be in the interest of equality, when it is INEQUALITY by design.
being fined and sent to re-education camps has been imposed upon several businesses which did not wish to participate in a homosexual themed event.
JUST now seeing the Oregon story and understanding that Portlandia is a fact based comedy. $400,000? Why didn't they make it $400 billion? Disgusting.
If there is any authority competent to declare that it can't be both, it sure as hell isn't the federal government; and given the 14A privileges or immunities clause, I'm hard pressed to see how any state would be either. So have you not read 9A, or do you just not understand it? You betcher sweet bippy it should. That's so bad it's good.
I am as pessimistic as you are about the unelected demigods on the supreme court We know four of them are flaming liberals who will vote for the homosexuals All they need is anthony kennedy who is forever teeter-tottering between sanity and liberalism himself Maybe he doesnt even know which way he will vote till he flips a coin or something
No, but they could and would be fired: The White House Executive Chef is the individual responsible for managing the White House kitchens, and for planning and preparing of all menus and meals for the President of the United States and the First Family, which includes their private meals, their private entertaining, and official state functions at the White House .....
And yet that same Supreme Court recently refused to hear two cases; one that lets Texas discriminate against legally married same-sex couples, and a Mississippi law that lets individuals working in government positions discriminate against gay people instead of doing the job they're paid to do by those same citizens. "flaming liberals who will vote for the homosexuals" The words you choose speak volumes. They convey an open hostility to my very existence. But we're not going back into the closet or the gay ghettos without a fight.
If they sell wedding cakes to the public, they must sell wedding cakes to the public. Pretty straightforward.
