I did not say there is not support for finding ways to penalize those employers who refuse to discipline workers who refuse to cooperate with trangenders they treat or work with. But the 'collective'( legislature) is not chomping to vote for this one as described, I can promise you that. Its going nowhere and means nothing unless it gets completely gutted and replaced with another that does not insult the intelligence of junior high student. Anyone who's second cousin twice removed, attended three law school seminars knows this is a pile of garbage.

What someone who is NOT A COMPLETE MORON, will try to do is level fines on the employer who allows his employees to disrespect transgender patients and clients by intentionally, knowingly and repeatedly refusing to use the client selected gender references and pronouns.

 

The employee thing is just bs. Its already illegal to sexually harass someone. They are looking for ways to pass speech laws.

Health care for elderly indigents is a lowly unskilled job. Most barely make minimum wage. These institutions already have to deal with supervising near imbeciles (I've known some in that industry). California keeps it up, no one will work for peanuts where it's worse than being a prison guard................ including the threat of some asshat statute of going to jail.

Think about the problem that this fool is probably really trying to address. This is my guess. You have a patient or client who is transgender who needs the services requiring frequent contact with staff either in an institution or as an outpatient. No matter how often they correct or remind the paid staff that they come in contact with, the staff refuse to address them by their chosen pronoun. In my line of work, we refer to 'dignity issues' when a patient's dignity is compromised by staff behavior and it merits a fine under Medicaid/ medicare rules in can include insults, demeaning or belittling references, overly familiar references, crass language, or 'baby talk' as well acts such as not pulling privacy curtains or covering someone who is headed to the shower. the government does not ban speech at all. It monitors and investigates complaints and punishes employers for conduct on its premises. As a constitutional question, this is no different that fining a hospital that tolerated verbal abuse of patients in its care or citing someone for contempt of court when he swears at the judge in a courtroom setting.

Clearly this legislator does not think current laws including sexual harassment statutes, in their state, cover this behavior under these specific circumstances. Its possible a 'victim' saw a lawyer, who looked into the wording, and said he/she 'had not case' so the victim ran to a legislator to change the law. if this specific legislator was not a lawyer, ( my bet is not) she/he threw this overly dramatic and draconian 'bill' into the hopper to get a hearing and have legal counsel look at it, while at the same time getting a little good press with her/his 'base'.

 

Yet the majority of murders in this country are committed by democrats.
