The problem is, if you remember the 213 to 213 vote where McKinney and Barr filed suit over the War Powers violations of Clinton, the case was lost because Congress funded the air war, in this case the Supreme Court will reject the emergency because Congress deliberately did not fund it. It doesn't really matter that Trump put them on notice, all that matters is, Congress deliberately didn't fund it knowing that they could have funded it. Can the president impound funds for a national emergency on budget deficit? NO, Congress wants it! I predict he will lose in the Supreme Court. Declaring a national emergency because of caravan invasions, issues that cannot admit delay, is one thing, any State along the border could stop them (if they wanted), the devil is in the wording of his statements, if because Congress refuses to act when it had the issues before it, he loses. A wall will do nothing for the drug issue — they use boats, tunnels, drones and catapults to vault over the barrier. People are a little easier to deter with a wall considering it is both tall enough and travels enough distance but seeing that 2/3’s of illegal immigration is visa overstays with quite a bit of the remainder being checkpoint crossings. Until we have programs that make living here difficult they will keep coming.
