We all are, for accepting this type of people and then defending them, regardless of what is good or bad. People do not consider the entire actions of politicians because basically, they have lost the initiative.
This started with the politicians meandering to the big business. You are right that frivolous law suits, but the problem is, they are no longer frivolous once they reach court. To set a precedent, that law suit needs to reach a high enough court level. They must survive many levels. Frivolous Law suits do not usually set precedence at all.

That fact that in the 80's The highest litigation figures in the world came from Australia, is most impressive. Due to the fact that everybody considers that the US are law suit happy. They do have some strange cases, but Australia has far more frivolous claims. The law in the 80's did not hear such cases, due to the fact that, they where frivolous. However, with government changing the law, meaning that now we have to have a scalp, means that now, everything needs to be taken into account.

NSW, now is considering fining people for breaking down on the road, because the maintenance has not been done correctly. Well, let us face it, if you just get some shoddy work done from a mechanic, how the hell are you going to know? You will have to be a mechanic, to know. As you are not a mechanic, should you do anything other than check the fluids in you car, then you are liable for anything that might occur after your trip to the workshop, meaning the mechanic who fixed the fault the first time, need not be accountable. Governments, have made this so difficult that, the only person who is left is the poor person that expects the job to be done right to begin with. Governments, now have to make laws to further complicate the issue to insure the best for the people. When will this happen? when one of them klingons get into trouble for it, you know those rich fanatical people who hang from the government, telling them what they should do.
When governments create Laws, that shift blame, Yes we should be blaming them. After all the government are the Law makers. Just for your clarification, Nobody, but the government can create laws. When you talk about the LAW MAKERS, I gather you assume bureaucrates, No government department can make a law. They do, however, write the law and hand it to government to enact the law. As workcover found out, when they introduced the Blue card to transport, the court ruled against them, under that very same pretence. It is about time, people should not just accept that bureaucrates are working in the best interests of the people, because they are not. They spend many hours of the day, trying to justify their job, for themselves.

Are you talking about foam carryouts? Or just plastic in general... rubbermaid, tupperware, glad, plastic bags and ziplocs, trashbags, plastic bottles, plastic milk cartons, juice cartons...etc etc. etc.

What. Is this how the feds are gonna get us to buy less? lose weight? die off?

You can't satisfy a greenie. We gave up paper bags and paper cups etc. Went to plastic. That is just a mess but necessary. Now WHAT? Shall we carry around glass containers? tin? Till they figure out they need to tax that too?

With this last ruling by the SC, the constitution is nothing, freedom, your rights...it means nothing...cause there is virtually NOTHING that they can't do to us.

Well, should you ever fond yourself in similar situation, you can challange it yourself, and find out exactly what you are talking about.

Ok, I will give you a well known case. A truck travelling through blanchtown SA, a car travels through a stop sign and runs into the truck, KILLING all occupants. Who was held accountable? The truck driver. As he was considered, not able to be legally at the place the accident took place, due to the hours he had remaining to drive.

You do not like, that a person can be held accountable, due to the LAW saying, should anything be wrong, the car can not be legally on the road?

And something you seemed not to understand, the decision is made from evidence presented in court, not all the evidence, as you assume.

OK, a real case exists...if you wish, can you PM the name of the case....Id like to research it without clogging up the thread....
seems as though an appeal should have been lodged...of course, the Court might not have been presented with all the evidence,
thats why we can appeal...this one seems to fall into the category of being bad and contrary to law....whether the truck driver
should have been there or not, an accident has occured, and people have been killed due to the negligence of the speeding
driver....sorry....I will discontinue the argument as its irrelevent to the thread.....

"NSW, now is considering fining people for breaking down on the road, because the maintenance has not been done correctly......"

This will not happen...why...because of the legal ramifications....read a little on the subject of "Causation and Remoteness"
under the law of Torts.....any in any case, what would we be fined for..."Obstructing a Freeway" ....this would be thrown out
the first time the Bill was debated.......

No, they are considering to fine drivers, for the congestion caused by them breaking down. should the maintanence be faulty, that is their problem.
Sorry, I have looked but I can not find the name of the case, when I do, I will let you know.

Yes, I see, the law of torts, covers the fact. However, how much are you going to spend to get out of a ticket that could cost you say $300?

Oh really, you suddenly suggest that a cash strapped state, who has budgeted to include fines as revenue, would really do the right thing and toss it out?

Seems, you think there is no level these politicians will sink to simply be re-elected, but actually trying to generate more revenue to promote their economic standing is not one of them.

You get your money back if you take the container back to where you got it from, so if we all did that, no one loses out.

    I'd support it.

And that would be a proactive thing to do. But taxing people is not.

Rewarding people for such things is better then punishing them

Good point, at this present time, people are studing just that. There seems to be some theory, that chemicals in plastic are leaching into the food stored in them. Could be very interesting the results of such studies.

Nah, I didn't like the way they cracked and got all messy and they never seemed to roll up straight. I like the plastic ones because they never crack and you always seem to be able to get one more brush full out them, even when they appear to be empty.

The shop owners will lose out because the returned plastic containers will cost time (rehandling), storage space & transport to a recycling plant. A better system would be to offer the refund on a per kilogram of plastic returned to recycling depots & not burden shop owners with it.

But will it be effective enough to make a difference or will it just be a reward for those people who are already doing the right thing? There is also a large cultural I am being cool & free component to throwing litter out the car window.

Except it will cost 20c per container & you only will get back 10c due to shop costs.

I'd think it's probably cheaper than actually employing people to clean up these bottles. The amount of plastic bottles you see on the side of the road out in more rural areas can be pretty disgusting, it's a pretty big problem. I've always wondered why we don't have a deposit on cans and bottles like SA.

I use canvass bags whenever possible. Aldis gives a choice. Bring your own bag/box or whatnot, or pay per bag. They also make you pay for the grocery cart, refund you when you put it back into its cradle. Not one errand shopping cart in the parking lot, ever. But they do leave you a choice, an incentive if you will, not a government mandated common sense.
We can't avoid using plastic at all times, but my personal responsibility dictates that I use what I must only. Cooking at home, not going to the store at the spur of the moment but planning ahead, thinking before going shopping and planning my route, bringing my own containers when possible...no one has to tell me that.
We should use our brain more often, instead of waiting for someone to tell us to.
