    Technically, that's not true either. 26 States, along with many other entities are suing for relief over Obamacare. Even if elected and inaugurated, most suits pre-election, evidence is produced he had lied or had knowledge of deceit of birth location (Constitutional LAW), Congress could pursue the Impeachment/Conviction process, removal from office, where Civil Action could be taken. As you should know by now, even if born in Kenya, is a British subject or even a planted Muslim Brotherhood member*, I do NOT want to see any former US President going to prison.

    *In the early 70's, managing a Lodge (Lakefront/motel/restaurant) for Brookhaven Country Club, Dallas and working with a Black College Fund raising group out of Longview, Texas, I actually hired many folks from Kenya, even a waitress (almost got me fired), most all of which were later granted citizenship.

    Your opinion is taken and might be correct, but only if the evidence can be properly investigated or judged by those qualified. On this from another thread, if Hawaii has locked up any person medical records, they could not enforce that law from a court order, President or otherwise and any future Hawaiian Congress could repeal that law....

    People go to jail everyday over some form of deception to obtain some gain for themselves, general money, on occasion even politicians. I could give you several possibilities, many of which will be tried if Obama was to win a second term, which I hope does not come to pass.

    I've done better. I've cited four Birther cases that were decided on their merits. I only needed one to prove you were wrong.

    As for Donofrio v. Wells, note that it does not say it was denied for standing... because it wasn't.The petition in front of the Supreme Court was a request for emergency stay, not a petition for certiorari. The denial of the stay (by multiple justices) was a decision on the merits of the request. The justices received the request for stay, recieved and read Donofrio's arguments, and denied the request.

    Why would you start this paragraph pretending you were going to point out how "technically" it wasn't true that nobody has standing, and then ramble incoherently about a half dozen random things none of which have anything to do with standing?

    1) Medical records are protected by Federal Law, specifically the The Health Insurance Portability and Accountability Act of 1996 (HIPAA).

    2) Unless associated with research, hospitals do not keep medical records any longer than they are required by law. HRS 622-58 only requires Hawaiian healthcare providers to keep medical records for 25 years. Obama was born 50 years ago.

    3) A birth certificate is not a medical record.

    Third Musketeer; Sorry, but I'm too old to change my writing style ("ramble incoherently") and frankly I don't normally even respond to post trying to attack a poster, especially when it's myself. In explaining standing, standing can be any entity, in that example a State. Then I proceeded into how a setting president can be held accountable.

    I'm pretty sure long form records of a birth are in fact classified medical records and why not normally issued along with the BC, but your correct in that a COB or BC are not protected. In any event, to my knowledge in any State those records in some manner CAN be used in a felony criminal case, for instance from someone qualified who has observed and tested them. I have no idea how many people have been prosecuted, criminally or civilly for sexual activity and STD.

    If you implying there are no records or microfilm records of ANYBODY born in Hawaii before 1986, why isn't that used to shut down the issue, though I'm sure there are records of all "Hospital Births" back to Statehood and well before.

    A "birth record" maintained in a healthcare provider's medical records department is a medical record. A "birth record" maintained by a State Department of Health is not. It is a vital record. The distinction under the law is not complex. But they are governed and protected by completely different sets of law, and while vital records must be maintained forever, medical records do not.

    Birth Certificates are not protected by Federal HIPAA law. They are protected by a number of different local privacy laws which vary from state to state.

    A pointless and irrelevant discussion. Any hospital record of Obama's birth would have been proactively destroyed by at least 1986. The Nordyke twin's too. Hospitals are generally rigorous about such destruction because it reduces their exposure to malpractice suits.

    Records that do not exist can hardly be used in a legal case... felony or otherwise, criminal or civil.

    I am implying nothing. I am being quite explicit.

    There are no medical records (microfilmed or otherwise) for anybody born in Hawaii before 1986... other than those retained as part of a medical study.

    There are certainly vital records... though probably no longer any microfilms. Among the reasons digital medical records were instituted in the first place is because microfilm has a shelf life even shorter than the paper originals. Once those vital records were digitized, microfilms would serve no purpose other than taking up space.

    He didn't trick me, I didn't vote for him. But I'm not going to pretend, like you, that he's ineligible to hold the office. That's crazy.

    Of course it is. Don't lecture me about law. Unlike you and the rest of your birther friends, I actually know what I'm talking about.
    None of which changes what I said, which is that no court in the world can remove a sitting U.S. President from office. Therefore, no court can grant a petitioner in these birther lawsuits what they want, and therefore none of them have standing.
    There is no investigation that needs to be done.

    Hawaii verified that the birth certificate is genuine. Do you understand what that means? Why can you people not get that through your skulls?

    That means there is no more investigation needed of the birth certificate. If you want to investigate whether the Hawaii DOH participated in a conspiracy with Obama, that is an investigation that can be done. Mind you, there is absolutely zero evidence of a conspiracy, but that is at least an investigation that makes sense from a rational standpoint.

    As I said before, asking for "investigation" of the birth certificate at this point is akin to investigating DaVinci to see if he participated in a conspiracy to make a fake DaVinci.

    The rightful creator of something is, by simple logic that should permeate the universe but somehow has missed the birthers, unable to create a fraud of their own work.

    I cannot "fake" my own signature. If I sign it, it's genuine.

    Hawaii says the birth certificate is real and it came from them. Therefore, it's real.

    Three Musketeers; If records are not kept in Hawaii for over twenty five years, disregarding the last entry rule, where is Gov. Abercombie going to get those additional records, claimed held in his Department of Health vault.

    Since all three of you constantly tell anybody remotely skeptical of all this effort to keep people from even questioning are few in number, what's your answer to 6 in 10 DOUBT Obama own eligibility story.

    BullsLawDan; I appreciate your trust in Government, but I've found that trust will often get you in trouble, than not. For ten bucks a head, I can get you personal letters from as many folks you wish attesting to anything you want, well maybe from Government Workers it will cost a little more, but you surely get my point...

    You still don't get it. No court has any authority to remove President Obama from office. Therefore no court can 'fix' any supposed problem. Only Congress has the power to remove a President. So no one can sue President Obama and get him removed from office. So no court is going to issue a fishing license to Orly Taitz so she can pretend to look for evidence.

    Congress can chose to investigate and impeach any President they want. No court can or need be involved.

    The State of Hawaii has repeatedly and positively confirmed that they have Barack Obama's birth certificate on file, as per Hawaii's policy, and that Barack Obama was born there.

    I would say that figure is incorrect, like everything else Birthers claim.


    So you don't trust the current, or the preceding Governments of the State of Hawaii, you don't trust the birth certificates they issued.

    What do you trust? How do you go through life? When someone shows you their identification, how do you verify it is really them? When you get into an elevator with that government certification in it certifying it has been inspected, do you demand to meet the inspector? Or do you insist on inspecting the elevator yourself?

    Healthy skepticism is fine. But I will point out that no President before Obama has ever shown you any evidence he was eligible and you had no 'skepticism' then. Nor have I seen any posts by you expressing skepticism as to the eligibility of any Republican candidates. Yours is a rather selective skepticism.

    If you could just admit this is really just about Obama's race, it would be so much easier to move on.

    Medical records are not held (in Hawaii) beyond 25 years. Vital records are kept forever.

    The figure is a dishonest spin on actual poll results.

    sometimes just doing the easy thing is ok. but the founding fathers didn't. 70 million people voted for obama as "the easy thing" also the wrong thing.

    admitting racism and moving on may be the right thing for the opresser. showing the documents would be easier than jsut "moving on" and disregarding the biggest scandal in earth history.

    you move on, i'll keep asking why he's hiding and distracting.

    He's the only potus in US history to have ever proven eligibility. So saying he's hiding and distracting is a flat out lie. Which is something you get caught doing quite a bit

    I point out again, the elitist culture of Birthers. They claim that anyone who doesn't agree with them must be stupid, ignorant, lazy, an Obama sycophant, corrupt. Birthers claim that only they understand the true meaning of the Constitution, only they know the true meaning of Natural Born Citizen.

    This is truly the elititism of the uninformed.

    BullsLawDan; Generally by the time the Election comes around, I've learned more about the Candidates personal history than needed, including all the bad stuff. All questionable detail had been reported, discussed, dissected and determined to my satisfaction. Even when you consider Obama's background, the dysfunctional family, his father/step dad's relationships to their Country and the times involved, it's easy to understand his obedience to Socialism or if you prefer an anti-imperialistic philosophy/ideology. This doesn't excuse the inconsistencies I SEE in that history, which is why I remain skeptical and no other candidate or elected PRESIDENT, in my life or my recollection of American History ever deserved that attention.




    Don't go there and you know full well my objections to the Obama Administrations are policy driven, which you refuse to discuss. Aside from that 4 of my own 7 kids and 6 others I helped raise (married their mother) are Mexican or half breeds. The last count (2002) I had there were 40+ grand kids involved, to my knowledge all living in South Texas, remaining in the Latino Culture, which I enjoyed for many years.

    No doubt, raised no less by Obama, race did play a role in the 2008 Elections, but in reverse from what your thinking. It didn't matter, he MIGHT not even be qualified under the Constitution, it didn't matter he was a Community organizer involved with Chicago politician, it didn't matter his history was convoluted with inconsistency, silenced or mixed response during the campaign or dozens of other issues, as in the Reverend Wright or association he had. All that mattered was he was not an old white guy, history would be made and far too many felt he WOULD GIVE them their needs, change the world to their liking, none of which was possible.

    Obama will not win a second term, the tea party folks, Americans in general are NOT racist and much of the nonsense of the past four years (yes, including the Compassionate Conservatives last year) will be reversed or repealed in total. The National Debt will be 17T$, 125% of GDP by the end of his term and there will be riots in the streets, both before and after those Elections, none of which was necessary. This is where I come from, not the racist angle you so desperately need to justify your own attitudes....in my humble opinion.

    None of that has anything to do with presidential eligibility. If you want to argue with this President's politics, there's a whole 'nother section of the forum for that.

    If you do not feel president has been vetted "to your satisfaction" then you have a powerful Constitutional remedy for your dissatisfaction. Do not vote for him.

    Margot; Kenya won it's independence, in the early 60's, from what they felt was an imperialistic English control, a colony of the British Empire and his mother Stanley Ann attended Mercer Island High School. I'll leave it to your judgement what young Obama Jr. was taught, but Free Market Capitalism doesn't seem to be his focus.

    Actually Obama Sr. went on to marry two more woman and 5 kids were born, but I have no idea where being a Muslim came into this discussion, nor do I care. I'll accept his being a Muslim, turned Atheist, according to wiki, but this would only validate "dysfunctional family"...
