Hahahah. We're a nation of laws? Really?? Would that be all laws? Definitely not a nation of laws when it comes to illegals crossing the border though. If these illegals violated the law then they should be tried and their guilt determined. Don't ya think?

    That's a tough one..

Yes he was right to chase the guy down and try to subdue him and rescue his kids.

I guess beating the guy to death is very incident specific. Mostly i am not to second guess a guy defending his family.

I think anyone who reviews this for two minutes and decides what should be done, lives in a fantasy world. We have investigations to reveal the details, which can make all the difference.

What we see in this thread is the Holiday Inn Effect.

That must be the reason why I keep hearing of dead children in hot cars.

So if I honestly but wrongly think someone is a rapist, it should be perfectly legal for me to kill them?

Honestly but wrongly? In this instance the father chased the kidnapper and pulled him from the car. There is no wrongly thinking the man was the kidnapper.

As for the use of potentially deadly force to stop a fleeing felon, in this case it's acceptable. The man was forced to relinquish the kidnapped kids, he then attempted to escape, a reasonable person could read that the man would continue to look for more kids to kidnap.

A kidnapper of three young children, caught, cannot be let go to catch another day for the reasonable fear that more children will be placed at risk. Tennessee v. Garner, 471 U.S. 1

Sure, but you can't address a generic rule or principle on the basis of a single example alone. You have to consider how that principle would work out in all the likely scenarios and situations.

The report suggests that they had successfully caught and secured the criminal. In what way would then beating him to death be necessary to prevent him fleeing?

Lets not pretend this was any kind of considered effort to catch a criminal, it was a reactionary summary execution committed in the heat of the moment, including a number of people who weren't even directly involved in the situation. You're free to try to defend that if you want to but you need to do that on the basis of the facts presented.

I blame the car thief. I always blame the criminal.

Children do not die in cars from a quick visit to a 7/11. Think it through.

Is it that important to keep your car cool? I live in a place which sees temperatures of over 100 on a fairly regular basis, but we don't do that. We just get back in car and curse :p

The question is, why on earth would you leave them in the car?

Like I said earlier, I wouldn't leave my kids unattended in a running car, but the people here are more trusting than I am.

Do you have a map of where people can reasonably expect to be car jacked? Why should everyone outside of those places not be able to protect their loved ones? This sounds extremely prejudicial and liberals will call you racist because we know where the highest crime rates are...

24 arrests for Erik Hood(LUM) Yeah! this guy was a model citizen according to Liberals. Beating him to death was a benefit to society, because it was only a matter of time before one of the innocent victims of his continuous criminal behavior died because of his actions. Death was justified for this Scumbag

Cite the mom for leaving the kids and the kidnapper got what he deserved. I wouldn't indict the dad for defending his kids. In Texas, deadly force is justified to prevent kidnapping. I don't know the PA law.
