    And since sales cannot be tracked, even illegal sales, a background check requirement for private transactions is unenforceable and thus useless.

    Explain precisely why the background check requirement for private firearms transactions has failed in the state of California. According to the ATF, the majority of firearms found in possession of criminal individuals, were originally sold in the state of California to begin with. This is despite every firearm and every transaction being subject to permitting requirements, registration requirements, and background checks.

    You still haven’t answered why the NICS shouldn’t be opened to civilian sellers as proposed by Senator Coburn. Nor, beyond your regurgitation of the GCA mantra, have you demonstrated any knowledge on the topic... that is babbling.
    You advocate for UBCs, answer the question regarding opening the NICS to civilian sellers.

    I doubt the anti's want UBC to work as that will give then another step to push for registration, which opens the door to confiscation.

    They know what they are doing and have many of their less informed followers many who falsely claim to be Second supporters backing them.

    That is true, the issue is less about guns and more about identifying gun owners who they regard as political opposition and obstructions to their objectives. They’ve already demonstrated what they will do with such lists in New York when they published the names and addresses of gun owners.

    The Miami tried that but the state AG fought them long enough for the Florida Legislature to amend 790 to make criminal the disclosure of licensee's names.

    Yes, after the NY media did their nefarious deed, several states looked to enact prohibitions against publishing gun owner registration/CCL lists, but make no mistake, the left would like nothing better than to identify their political opposition and expose opponents to the harassment of the indoctrinated mob. You see elements of that in the harassment, sometimes violent, of MAGA hat wearing individuals or the doxing of conservative news pundits over the last couple years as advocated and egged on by some in Congress.

    Someday and probably not too far into the future, that's going to bite them in the fanny, they may think they are gaining traction for their cause, but a lot of normal people are turned off by such thuggery and someday a victim of it is going to push back hard and will be seen as having taken the correct action.

    Because it is an obvious civil rights issue. I bet even the NRA doesn't endorse that. But just for yucks why don't you explain how system would work. And What penalties did he propose for civilian sellers that sold a gun without having the background check run?

    If someone is apprehended who posesses a gun that was prohibited then you just impose prison sentences big enough to incentivise them to give the source of the gun.

    All guns in California are required to be permitted and registered and every sale requires a background check? When did that happen?

    Just for yucks why don’t you query Sen. Tom Coburn’s NICS proposal yourself; I have posted links to it it more than once. BTW, re the NRA, You’d be wrong. Re, penalties, see for yourself. As for any sale of a gun now, without registration, how would a private sale be tracked now? As long as registration, currently prohibited under federal law, is on the table, UBCs via only FFL middlemen, not only won’t happen, but can’t be enforced with the nearly 500m unregistered guns in private hands now.
    As for compliance, do you suppose most gun owners don’t care who they sell a gun to? Really?

    By and large law abiding gun owners, if they are not FFL's will not transfer a gun without involving an FFL, the risk of civil liability is too great.

    As such UBC laws will change nothing, law abiding transfers will, as always go through NICS and criminals will ignore UBC as they do many other laws.

    UBC is simply a step in the anti's goal of forming a national registry which is step one to confiscation, they know it, we know it and their minions should know it, but commonly lacking any real knowledge about guns and history do not.

    Which is something, if ever put into place, being unarmed, they will regret.

    And the one who supposedly performed the illegal sale can simply say the firearm was stolen, and deny any knowledge of the sale. It will be the word of the prohibited individual against the word of the non-criminal who is now claiming to be a victim of theft. If the matter goes to trial and the accused denies the sale ever took place, even if they did knowingly commit the sale, the jury will side with the seller since they have no criminal history, and the only one who can claim otherwise is facing a prison sentence for the charge of illegal possession of a firearm.

    Do not merely claim such as being the case, actually go about demonstrating how such is the case.

    How such a system would work is quite simple. Observe the following:

    Person A is advertising a firearm for sale. Person B approaches Person A with the desire to purchase the firearm in question. Person A requests some manner of identification and calls the FBI to perform a national instant check on Person B, while reading them the identifying information. The FBI, searching through current databases, will either inform Person A that the sale can proceed, that Person B is prohibited from legal firearm ownership, or will put Person A on hold temporarily due to issues with the databases and their searching thereof.

    It is ultimately the exact same process that is in place currently when one attempts to purchase a firearm from a federally licensed firearms dealer.

    The GAO had agents try to buy firearms on the net and law abiding private firearm sellers refused to sell them to the agents posing as prohibited persons.


    GAO agents attempted to purchase firearms from Dark Web and Surface Web marketplaces. Agents made seven attempts to purchase firearms on the Dark Web. In these attempts, agents did not disclose any information about whether they were prohibited from possessing a firearm. Of these seven attempts, two on a Dark Web marketplace were successful. Specifically, GAO agents purchased and received an AR-15 rifle and an Uzi that the seller said was modified so that it would fire automatically. GAO provided referral letters to applicable law-enforcement agencies for these purchases to inform any ongoing investigations.


    Tests performed on the Surface Web demonstrated that private sellers GAO contacted on gun forums and other classified ads were unwilling to sell a firearm to an individual who appeared to be prohibited from possessing a firearm. Of the 72 attempts agents made to purchase firearms on the Surface Web, 56 sellers refused to complete a transaction: 29 sellers stated they would not ship a firearm and 27 refused after the disclosure of the undercover identities’ stated prohibited status. Furthermore, in 5 of these 72 attempts, the accounts GAO set up were frozen by the websites, which prevented the agents from using the forums and attempting to make a purchase.

    With no accounting of the agents who were told the sale would proceed, but never received the firearms they paid for because the sellers actually took their money and ran.

    It is not the NRA that is facilitating the illegal trafficking of firearms to prohibited individuals. Rather it is those who are presenting the demand for firearms, and are willing to pay substantial amounts to get them. Without demand, supply simply does not exist.

    Gun controllers are so idiotically simplistic in their thinking. They can't comprehend that the only so-called "loophole" that exists is that criminals - by their very nature - ignore the law, and despite some claims to the contrary, the law does exactly nothing to physically prevent someone willing to violate it from doing what they want. The law can only provide the mechanisms to punish the criminals after the fact.

    We have drug smuggling because of demand. Bad guys will always be able to get guns... because of demand. Someone will always find a way to supply that demand, regardless of the laws implemented.
