    The defense said Spencer Carlton was not aware his actions would cause harm when police say he shoved a man who had allegedly groped his wife at a West Sixth Street bar in March 2016.

    Believing prosecutors will not be able to meet their burden of proof, Carlton’s attorneys said he should be innocent of charges related to the death of Jerry Don Summers, who was taken off of life support three days after police say he struck his head on a tire stop near the corner of West Avenue and West Fifth Street.

    Carlton, 54, is charged with criminal negligent homicide, a state jail felony that carries a maximum punishment of two years behind bars.

    I see you are a professional victim, always making the bad guy a good guy. It is simple. He could have stood between his girlfriend and the old guy and ask "whats up". Then there is no aggression or reason to be shot. However, he just didn't push him down, he gave a mighty shove. His intent was to do great bodily harm to this old man. How dare he question his girl for parking in a handi-capped spot??? He didn't tell the old man to mind his own business, he ambushed him, and the fall to the ground from that heavy push could have ended up in the old man busting his head or other parts on the concrete.

    I will tell you what, it is OK to shoot me the next time I push someone to the ground very hard without a reason. I will live a long time, because I don't assault other people except in self defense, and then like the old guy, I shoot them.

    Demonstrate the supposed harassment that supposedly occurred.

    Then present what is believed on the part of yourself, as amounting to adequate training for the legal carrying of a concealed firearm in the state of Florida. Do not bother proposing such a course of action unless there is something worthwhile to contribute to such a discussion.

    True. There are a lot of unknowns.

    Its a huge tragedy for everyone involved both directly and indirectly. A lot of people are suffering and will suffer for years.

    Its one of those cases in which there were many opportunities to take very simple actions that could have broken the chain of events.

    Again, deadly force should only be used to protect your life, not your fragile ego. You can't possible know what the guy who shoved him thought. You think he was trying to show he was tough and king and you'd shoot him just to show everyone you were, not just because you were afraid for your life. And that is what all of you supporting this shoot are saying. You're saying you would be afraid for your life in this situation. Really, what kind of cowards are you that a little shove has you afraid for your life?

    The flip side to also consider is that this guy was kinda old. Once you reach that age you start to have less inhibitions about confronting people.

    It doesn't look like he's being aggressive standing there. He's not even that close to the car.

    I'd say he's calm because of his body language. People who are being jackasses tend to gesture with their arms a lot and lean forward.

    I don't see any of that body language from this video.

    And shoving someone off their feet is not a shove, more like a football defense move,
    makes the aggressor liable for what follows. Moi's Rule see above.


    I would like to see females have dress codes for the work place.
    We need "Man Cams" to record flirtations and such aggression or "rape me" invitations.
    But, the waitress was not at a work place as such.
    She was working at a site where the temperature was 100F inside, and outside too.
    Savannah, Georgia. (Got Humidity?) So she gets a "pass" and the guy is certainly at fault as the one to make first physical contact.

    Yea I'm still waiting on an article or video proving this. And if he was...which hasnt been proven on this thread yet...why was he yelling the last time? When you're carrying a gun; you lose the right to lose your temper, but how does what you're saying justify the other man's actions.

    The thug's finger in her face while he's screaming at her is not justification for him to push the thug away from her?

    What video are you watching? Or should the question be: what life do you live?

    In any case, you completely miss the question. Even if he were the aggressor, how does that justify killing him? He pushes the thug, and takes a step back....

    My mistake, I thought he was older than that. His body language and appearance don't seem only 47 from the video. He looks a lot older than 47.

    I'm admitting if I'm confronting someone who's parking in a handicapped spot and someone blindsides me so hard that I'm knocked to the concrete, then advances on me, yes I'd probably draw as well.

    I wouldn't have been caught by surprise though.

    The tale is full of lies.

    They said the parking lot was full, and that's why they parked in handicapped spot. Video shows differently.

    The woman said she was minding her own business and not being aggressive, but the video clearly shows her getting out of the car right as he get's blindsided.

    The woman said the guy was just pushing him away from her, the video clearly shows him advancing on him until he realizes he brought bare hands to a gun fight.
