As a quick aside, I wonder how many judges have to hire their own lawyers to represent them on appeals. It seems unusual. Anyone with more knowledge care to comment on that?

Anyways, on to the goods: Here is the response that Sullivan's lawyer gave to the appeals court and here is the DOJ's 45-page response.

And here's a bit of commentary on the unusual case, for those not interested in the legalese:

The Hill - Judge in Flynn case asks appeals court to allow argument against dropping charges

Politico - DOJ urges appeals court to force dismissal of Flynn case

Federalist - Judge Sullivan Finally Responds To Mandamus Petition In Flynn Case, Proving Why It Was Necessary

Bottom line, Gleeson will present his case in about a week and Sullivan pushed any arguments on the matter to mid July...

I expect Flynn will be imprisoned on criminal contempt of court, a clearer case you may never find...

You did read the DOJ's brief to the appeals court, right?

There's more, but i don't want to fill the whole page with quotes.

There are trying to gazump, hustle Sullivan, to stop him finding out what the DOJ obviously very desperately does not want him to find out. Dirty deeds were to be done dirt cheap but Sullivan was onto them and did not just pull out his rubber stamp as they wanted, the DOJ and Flynn.

It continues to amaze me why people do NOT want Sullivan to look into the entire background of the original pleas of guilty, Flynn now wanting to recant those pleas (made under oath) and why the DOJ are so anxious to get the hell out of there.

Those justsecurity.org articles are incredibly detailed... I have trouble following some of them...

If I was to guess, I'm going to say this appeal will eventually have to be held "en banc" as well, since I believe the 3 chosen judges will not make the correct decision that the decision is completely up to Sullivan.

I will read the Gleeson brief in full when it's filed.... Post it on here if you see it...

Not “pending criminal charges”. There are no charges “pending” against Flynn. He has already pleaded guilty.

They are pending until the case is done. The case is still open, he has not be sentenced.

I think you will find that the charges are not “pending”, even if the case remains open because he has not been sentenced. The sentence is pending but the charges are not.

The case is still pending. The charges aren’t they have been brought. People are allowed to change their plea before the case is concluded. It happens often in particular when corrupt cops are exposed as was the case here with the obamagate gang

    - Never predicted a Hillary win (on PF.com anyway)
    - Never called Trump a Russian spy - Anywhere at anytime
    - The Trump campaign did collude on many occasions with many different Russians during and after the election.
    - Trump's hair dresser should be executed, regardless of his or her country of origin.

"Show me the hair and I'll show you the crime"

The Gleeson report is in... no real surprise so far, although haven't read his filing yet

It's 82 pages... from a judge... there goes my afternoon.....:(

    https://www.courtlistener.com/recap/gov.uscourts.dcd.191592/gov.uscourts.dcd.191592.223.2.pdf

    SNIP
A former federal judge appointed to review the Justice Department’s motion to dismiss criminal charges against President Donald Trump’s former national security adviser Michael Flynn said there was evidence of a “gross abuse” of prosecutorial power and that the request should be denied.

Former U.S. District Judge John Gleeson said in a filing Wednesday that the government “has engaged in highly irregular conduct to benefit a political ally of the President.” He urged the judge handling the case to deny the motion and argued that Flynn had committed perjury.

Gleeson completely debunks the whackadoo theory that Flynn only pleaded guilty because of some pressure put on his son, or some such nonsense (Page 28)...

This is a actually a readable (so far) review of the entire case....

I have just read all of what Gleeson has filed. Totally spot on, and I hope that Sullivan gets the opportunity to drill right down into this farce. Barr could be in strife as is Trump. Jayzuz, read it. It takes time and patience, but if you are fair dinkum, you will read all of what Gleeson has filed and you will see that everything he said is sourced. Bloody great job.
