On private property yes, it's not the government doing it it's the property owners who have a right to control access to their property. And it's not "papers" as showing your "papers" is used, it's showing a signed bill of laden or work order showing you were authorized to be on that private property and by whom. Then they can take it up with that property owner if they did not follow the community rules for outside access.

 

I already posted an example from the last time I was going into a gate community last 4th.

And I've said this before, the HOA members had no right to access the private, personal information regarding the transaction, and the driver had no legitimate requirement to furnish that information, to some random person who failed to provide one shred of evidence that he was who he says he was.

It doesn't matter if it is private property, the Fourth Amendment still applies.

 

Seems to me like this was all a nice setup. All he had to do, which is exactly what I would have done if confronted and asked why I am on private property, is to show the paperwork/orders of why I was there. In fact, I have had to do this, many times in my life, and I am whiter than a ghost.....Instead, he decided to not do that, and got a phone out for video, as he intended to play to victim of racism.

Why on earth would you not just show your legitimate reason for being there? There is no valid answer for this, other than to push an agenda.

 

The owners of that private property have EVERY right to do so and this was their elected President. Not a 4th amendment issue.

 

I doubt that Dave Stewart owns the HOA, he is merely it's mouthpiece. Still doesn't give him any right to access private purchase records of HOA residents, which is what he was demanding to see.

Oh stop with the inane comments, he is the PRESIDENT their elected REPRESENTATIVE. ALL property owners must abide by the rules and that means properly clearing people onto the property and protecting the security of the property as in handing out entry codes. They guy could simply have shown delivery receipt even covering up the items and showing the address and then be on his way.

 

You are under the assumption that the driver was given a gate code. As a home health nurse I find this highly unlikely. More likely is that the driver accessed an electronic list at the gate and pressed the number for the resident he was delivering to. That resident then opened the gate remotely. This is how it works in every single private neighborhood that I routinely visit, and I suspect that is what happened here.

If so, then the HOA Gestapo knows this, and knows that the driver could not have accessed the neighborhood without the consent of a resident. That should have been the end of it considering that the driver was driving a commercial vehicle while wearing a commercial uniform which clearly indicated the name of the delivery company.

I still contend that the Gestapo had no legitimate reason to view the delivery documents, and the driver was under no obligation to provide them.

 

And that is what the President of the HOA was trying to ascertain whatever was the means to gain entry and I bet the drivers boss told him next time show your paperwork you are costing me time and money and threatening any access to those homes in the future.

 

Well, this post just goes to show that you didn't bother watching the video as the driver contacted his boss, and the boss was fully supportive of the driver.

What the Gestapo should have done was call the delivery company directly, explain who he was and why he was calling, and ask the company to confirm that the driver had a scheduled delivery within the complex.

Instead he wanted to be John Wayne and blocked the delivery truck with his own private vehicle.

My guess is that the other HOA members are probably a bit peeved at the self appointed Gestapo agent because of all the unwanted negative publicity.

 

His freedom of movement was restrained - arrested.

 

He's on private property and the owners of that property have every right to question why he is there, his refusal to answer raised the suspicions, he then got unnecessarily belligerent after the PRESIDENT of the HOA asked him nicely why he was on that private street. He had gotten himself lost and was making u-turns if the President of the HOA or anyone else living there asked him where are you going ALL HE HAD TO DO WAS ANSWER instead of acting like HE owned the street and could go wherever he wanted to in the private community.

 

He has no such freedom on private property, his being there must be properly authorized.

 

Not if you are in compliance with the rules and mandates no different if you are white.

 

I think he does have that freedom even in a gated community.

It's PRIVATE PROPERTY. Even the street is PRIVATE PROPERTY. If I turn onto a street marked private property and we certainly have them around here anyone living on that street has every right to question me why I am on it.

There are private dirt roads in the county here. If you are not known, you will be questioned no matter what color you are. A certainty. And chances are, you wont have a gun pulled on you but there will be one in the truck.

What he was doing there, was something between him and the guy who employed him.
