NY lawmakers propose law to prevent Trump from avoiding prosecution

    Not sure if you've looked into this any more but it seems, listening to that part of the hearing on c-span, that they haven't been holding off by choice on serving the subpoena.

    When Leval suggests that to him, Dunne vigorously denies it. He explains that it was his understanding that they weren't permitted to serve it, further to the 2nd Circuit ruling on Sep 1 which ordered "a stay of the district court’s order and judgment" pending appeal. When asked for his opinion, Consovoy says he believes it's stayed, for the same reason, and Leval (who wasn't present Sep 1) says he doesn't understand why a stay of the district court's order means the subpoena is also stayed. Lohier and Katzmann, who were present Sep 1 (at least, their names are on the ruling) don't say a word.

    Which is all very odd.

    Anyway, at the very end Leval asks both sides to write a letter explaining what they think the situation is.

    Very confusing... But it's ultimately moot, isn't it? When this 3 judge panel decides Vance can proceed, it's over except for the SCOTUS.

    Unless one of the Trump appointees requests to hear this en banc.. My count shows the court is even divided between GOP + Trump appointees and DEM appointees, so I'm not sure what sort of panel they could draw.

    However, delay is really all Trump has ever been after here...
