While that could be considered a reason postulation except Trump may have backed himself into a corner so that he would have to sit back and let justice take it's course.

For what? He was legally sanctioned already and paying his fines in the civil matter and I don't believe you can be pardoned for a civil action and plea bargained the criminal charge losing his license to practice law. A pardon could not undo any of that. What other charges did he still face?

That depends, who in the State Department Office of Legal Counsel and Security Office said that the manner in which she was handling ALL her official email was legal and violated no legal regulations?

    - - - Updated - - -

I could be wrong but I bet they have to become part of the public record and national archive upon issuance.

Really, can you share a single piece of Top Secret email sent/received by anyone else beside Hillary Clinton in that position? Go Ahead. We will wait.

We have confirmation that she did it over 1,000 times.

You are talking out of your ass.

From the Non-Disclosure agreement Hillary signed........

It clearly states classified is marked or unmarked.

Searching...searching...nope, don't see a law there she may have broken only a definition of "classified". 13 republican led congressional committees could not come up with a law broken, the State dept couldn't come up with a law broken, a republican FBI director couldn't come up with a law broken yet you can.

Read the constitution where there is no such limit on the pardon power and the constitution is the only place such limits could be apply.

    Probably a quiet retirement...

The thing is, the dumbest thing Trump and Sessions could do is try to prosecute Hillary after the FBI cleared her.

The thing is, any such trial would be held in DC, where they vote 96% Democratic. Try finding a grand jury that would indict, or a jury that would convict.

For the last time....you cannot "Pardon" someone who has not been charged or incriminated.

Sorry, placing an SAP document on an unsecured server violates the law, at least from my perspective. But you are absolutely right, that determination should be left up to a special prosecutor to make. Either she was wrong or I am wrong. I look forward to hearing which it is...

    Yup. It's not rocket science...

So the material in question was, in fact, classified.

As to the actual laws broken, three simple ones are described quite nicely in this article:

    Yup. It's not rocket science...

The gross negligence caused these eMails to be lost and she did not turn them over when she left. She allowed them to be lost or destroyed.

Just because the AG was a puppet for the Party and wouldn't prosecute doesn't mean laws weren't broken.

    As far as impeachment.

For what did he need a pardon and since I am sure Bush wasn't going to issue one why would Obama? Obama could jot ppardon the llaw license removal and again I do not bbelieve it would abpply to the civil charge espscially after tbe fact. So what would he have sought a pardon for?

What is very possible now is that President Trump will busy himself with more urgent matters and he will turn this whole Hillary bag of worms over to Attorney General Jeff Sessions for examination. The whole issue of her breaking laws against national security and classified information may be on the table, but even more likely will be the incredibly horrible racketeering crimes of turning her State Department into a gigantic WHOREHOUSE for wealthy international donors to her Clinton "Foundation".... With his skill, Jeff Sessions could take that whole rotten, corrupt pile of Hillary's (*)(*)(*)(*) apart like a Christmas turkey....

It seemed most of that was a witch hunt.
Gingrich resigned over the failed hunt.

Witch hunt??? He committed perjury and obstruction of justice in a federal court and a federal grand jury, both felonies. What was the witch hunt?

I'll expect you to express the same outrage over the Bush Adminstration's efforts in that regard.

Otherwise, I'll just have to assume that you're just a hypocrite.

The peaceful transfer of power, on which our freedoms rest, depend on the new Administration not trying to jail the outgoing administration!

Please link me one site that shows a single American ever being prosecuted or convicted using the charge of gross negligence in the Espionage Act. I'll understand when you can't because no one has ever been prosecuted or convicted using the gross negligence charge of the Espionage Act. THAT is exactly what Comey meant when he said, "no reasonable prosecutor would bring such a case," because it would be unprecedented and appear politically motivated.

There's no doubt that Comey laid out a case for gross negligence, in his opinion. However, at the very time he was doing so, he knew no charges would come from it. This is the main thing former FBI Directors have said was his biggest mistake.

How about an FBI agent being indicted for it? The charge was dropped after he plead guilty to giving false testimony.
