And of course, Drake's case demonstrated an interesting point. Even though the program was against the law, reporting it to the proper authorities did not address the problem. Snowden, being familiar with Drake's case would not have any reason to believe his complaints would be met with anything other than an equally unpleasant outcome. In essence, Snowden had no reasonable outlet other than the press, in which to report the abuse because the chain of command was likely already aware. There is no clear cut line here, because Drake's case demonstrates that there is no operational method in which an abusive program can be reported and addressed. If Snowden had concluded that he had no accessible means other than the press, he could argue that he lacked a proper method of grievance. However, this would not likely be accepted as a valid argument, and in fact, it falls short of Drake's ability to make that argument, since Snowden did not attempt the process. While whistle-blower protections do not appear to provide much of a defense for Snowden, extradition of this kind is very difficult because of the very nature of foreign affairs. Additionally, public opinion and political will plays a huge role in Snowden's fate. It is unlikely he would face the full extent of the law, and rather the outcome is more likely to resemble what happened with Drake. The worst case scenario is that Snowden ends up sipping margaritas with Assange in Latin America.

Yes... it is interesting that the whistleblower protection act for the intel community doesn't protect people, but protects the divulged information from reaching congress. It is just a redaction program. However that is far from the worst case scenario. The Russians could torture what he knows out of him and leave him in a frozen river bank... he could be rendered/assassinated by the CIA... or really... he could be droned out according to this admins logic. Drake also did not release secret files... he just had some in his possession. Snowden faces much more reprisal than anyone outside of the FBI guy who was selling secrets to the Russians.

I don't expect the torture or assassination scenarios would take place. Perhaps I'm overestimating the level of discretion still in the world, but it seems to me that too many eyes are on this. Besides, I have to tell myself that world leaders and their intelligence communities are smart enough to realize Snowden's death would incite a hacking war. I know it's deviating a bit from the subject, but no one knows how much information is just floating around out there in the hands of potential activists, just waiting for a reason to retaliate. Additionally, in a world of carrots and sticks, Russia would be more wise to give Snowden a carrot. Since this type of leak is most likely to be to the detriment of the U.S., foreign governments would be wise not discourage it. And by detriment, I only mean being caught in yet another contradiction. The focus on Snowden is nothing more than an attempt to distract the public from the fact the government continually breaks the law.
