Definitely, even soldiers guilty of war crimes should be judged considering the extreme stress of war they were in.
Nazi war criminals obviously deserve the death penalty, for example. And to not give them the death penalty because you have forgiven them is wrong in my view.

Definitely most soldiers are heroes rather then criminals to their country. If they are captured, the captor may treat them as war criminals.
I mean that's a very difficult question to answer. I think that's why murderers and rapists are put on trial so the judge can determine their punishment individually. Some people qualify for the death penalty, while others only for life in prison, or a long prison sentence.
