Funny how it wasn't found unconstitutional in 10 years. I remember that discussion about the mandate. Since it is a tax, it is not unconstitutional. However, I am not a law expert and say this from memory, not from doing research.

Yes, Justice Roberts twisted like a pretzel for that one. I'd argue even as a tax(and this is now before the SCOTUS), now you run into interstate commerce. And is taxing individuals for buying or not buying a legal maneuver under interstate commerce and if so, are there any limits?

Because theoretically the government could tax you for not buying item x. Like for example, Ivanka's fashion line.

 

True charity comes from ones heart by choice. Democrat pseudo charity comes from taxpayers at gunpoint as if it were a debt. And never the twain shall meet. True charity cannot be owed or demanded, because to presume to be owed charity is to deserve hell. To the priest craft of liberalism, God is an amateur. They're more into image than doing. Why should a Democrat sacrifice his/her life in actual service to even one needy person when he/she can pass legislation to create the appearance of having served them all, thus keeping Democrats lives to themselves, and the needy at a great distance.

It's not a tax. It's a fine or penalty for not purchasing something the government wants you to. This does not meet the definition of a tax.

Incorrectly ruled. There is no historical precedent for that that interpretation in law or in common use and certainly not in the time of writing.

 

Oh I agree. Only the House can create taxes and the ACA began in the House as a housing bill before being completely reworded in the Senate as the ACA. The proof is right there on Congress’ website.

Well, you should. After all, Barrett is gonna be making decisions about your Country, you and your family for a very long time. My own preference would be to have no-one on Scotus who occupies a place in the extreme religious fringe.

 

We’ve had extreme liberal fringes like Ginsberg in the Supreme Court. Why not an extreme religious fringe to help balance things out?
