They are legal, but they are usually discouraged or prohibited by department policy. The fear is that a warning shot will hit an innocent person. But no, they are not illegal.

Well a warning shot directly into the air isn't likely to hit anyone.

It's going to come back down somewhere. A better warning shot is into the ground outside. If you are indoors, a floor is OK as long as their is not a floor below you where people may be. A corner is also fairly safe because corners have more structure inside them than walls do. In any case, the officer firing a warning shot is responsible for that shot. The Capitol riot was a rare instance where a warning shot may have been a good option, but I'll bet you a dollar warning shots are prohibited by Capitol Police policy, and so that option was never given a thought.

yeah, but that combined with storming the capital, busting through doors and climbing through, that is definitely considered a "THREAT"

you have lost this one Chris, give it up

Walking away before they got through, as we saw happen all over the Capitol. UNLESS he was trapped, or others behind him were.

Yeah. If an officer fires a shot, he's responsible for it, no matter what happens.

A pistol shot from a typical police pistol can travel up to a mile or so.

Oh it's certainly a threat. But this doesn't mean that they were going to follow through with it.

Well it's illegal for citizens to fire warning shots isn't it? Certainly in alot of states I would imagine.

So you're admitting to downplaying it! And you criticised Trump for downplaying the coronavirus!

Depends on the hardness of the material it runs into and the angle it runs into it. If a typical bullet fired from a pistol runs directly into steel, it shatters into small pieces. But that same bullet fired at a substantial angle will mostly bounce off the steel and keep going. Same thing with concrete or asphalt. Bullets will typically penetrate softer materials like wood, rather than ricochet.

No, it's not illegal for a citizen to fire a warning shot, generally. But, like the police officer, that citizen is responsible for that shot. If it hits someone, the shooter will have to face the consequences for negligently shooting that person.

So it sounds like shooting into the ground isn't a great idea.

It depends on the ground. Something soft like a lawn won't ricochet. But you can definitely get ricochets off hard or rocky ground, especially from high speed bullets fired from a rifle. I've heard bullets ricochet off a farmers alfalfa field when fired at a sage rat with an AR-15 rifle.

if they had just protested peacefully outside, not a issue, going after members of Congress and the VP, then it's an issue

so you think I post a video of a GOP member threatening to throw a reporter off the balcony means I am saying all republicans are violent thugs, could I just not be showing an example that counters the one about the dem, showing there is evil on both sides, did you think pointing out the dem example was saying all democrats are violent thugs?

To be honest, I didn't know what you were responding to, because you didn't quote a post in your post. Plus, you said that you posted it in the wrong thread, so that didn't help. So yeah, I admit that I didn't know the context, but it seemed that you were doing as many are doing and lumping all Republicans in with the human waste January 6 rioters. However, I should have remembered that you are one of the few decent people on the left.

You can't say that they were "going after" them.
