    To the extent that they're in any legal jeopardy at all, it's almost certainly for a state-level crime, not a federal crime. Last I checked the President can only pardon for federal crimes.

    The sidewalk is a PRIVATE COMMUNITY. It is owned by EVERYONE IN THE COMMUNITY.

    Therefore the McCloskey's, who are owners in that community, OWN THE SIDEWALK,

    Why do youse people FAIL to understand the sidewalk in that community is neither owned by the public nor is it accessable to the public?

    2020-the year where the American Experiment died because enforcing the law and protecting citizens became too expensive. What a sad state of affairs, and we know that's going to be what the Biden 'administration' will be.

    Would a difference be made if said individual standing in the yard either scaled a fence, or broke through the locked gate, to get into the yard, rather than simply stepping over the sidewalk?

    Uhh yea if a mob tore down a gate and is on your property and you've seen mobs loot and burn property for days, your damn right I can wave a gun at the mob.

    Since none of you understand castle doctrine laws and are incapable of looking it up (not surprisingly from the anti-science, law, ethics, logic party)

    Not when you are protecting your life and your property from a violent mob with smoke from parts of your own burning city in the air behind them. The biggest irony, however, is that this is a liberal couple and before this happened their latest client was a . . . violent . . . rioter.

    Perhaps actually looking up the law and reading what is there for all to discover would be the best option before just saying things that are probably not applicable here. Just sayin.... But hey, for all of those cool folks in CHAD, I suppose given your logic, they all go to jail for "brandishing weapons".... Sweet.

    They broke through a gate of a private community.

    They were trespassing & Missouri has a stand your ground law.

    The prosecutor will lose in court, but he is just grandstanding anyways.

    As liberals are want to do. Maybe they thought they could drum up some extra business by getting themselves on TV... Cause that would never happen...

    I still cannot believe that active trespass isn't a defensible position in castle doctrine there though. In other states, once you step foot onto the private estate, even of an HOA governed estate property, it is a pretty good case for dismissal if the trespasser is shot.... I wonder if the Governor will step in and supersede the local DA here just to make the point that he can.

    I have looked up the law, I even posted it and some legal analysis of it for those brave enough to read (for those that have basic reading comprehension anyway)

    As for CHAZ or CHOP — if they pointed weapons at anyone then they too are guilty of brandishing and I hope they are arrested.

    The can be agreement. It's awesome. So, now apply what we know to the condition of self defense and castle doctrine, and voi la... We have a theory. I still think these creatures were simply trying a new marketing scheme designed to persuade otherwise conservative folk they could be trusted in their ambulance chasing schemes....

    As I mentioned in a post earlier in most states in a condo townhouse complex like I live on the entire ground is common. The "roads " are treated by our town as if they were a driveway. We pay for maintenance plowing and taxes on the roads. We as owners technically are shareholders in a non profit corporation. Technically the second someone who is not invited steps on the first 1/1000 of an in on the HOA they are stepping on my property and everyhome owners. So it is the Partizan Castle when the "toad" hits my driveway.
