Not really old chap - again in those cases you have a reasonably clear body of evidence - where is your evidence here? Do we charge all bystanders every time someone has a heart attack and dies just because they "might have saved them?" So we cannot charge every woman having a miscarriage/failure to implant

There is no "person" in the early stages of pregnancy.

Even if there was a "person" it would not be living until it met the criteria for a living person which would mean would have to have a functional heart and have significant brain function.

Abortion is different from other "deaths." The only way to catch any woman having an abortion is to investigate EVERY miscarriage, and that will not be possible either since women simply won't report every miscarriage. You would also have to monitor every woman's mail and package delivery for contraband drugs. You will have to do pregnancy tests on every woman leaving the country. The civil rights issues boggle the mind.

According to developmental biology a human does not exist at the zygote stage.

If there is no human there is no person so the statement "every person goes through stages where the brain does not exist" is not true.
