    She chose to be blindfolded by someone she didn’t know intimately. She chose to not know.

    The woman in question was old enough to consent without having ever seen her so called male lover. She was old enough to decide that. Crying rape two years later is just sour grapes for guessing wrong.

    she didn't consent to have sex with a woman she can send it to have sex with a man the woman was an imposter.
    She couldn't give informed consent if she was not informed.

    She was under the impression that this person was a man. And this person lied to her about who she was I don't see how that's not right understanding what other things are.

    Take the blindfold scenario what's the difference?

    You keep saying informed while completely disregarding a million other ways people can consent without being informed. You are choosing to decide for other people, what is valid and what is not.

    The only examples you have of this was a prostitute being ripped off and a neoteric person with poor follow through.

    Again you don't have sex with a bank account or someone's diet.

    Of course I have. Your committee simply disagrees with what constitutes a rape lie versus a non rape lie. Extremely subjective. You want a government committee to decide. I prefer personal responsibility.

    That's hardly an argument. And she was not actually trans; she was just a lesbian tricking another woman into thinking she was a man so she could have an intimate sexual relationship with her.

    I usually agree with personal responsibility. But in this case the woman's emotions were manipulated and she was taken advantage of.

    I totally understand how you see this as subjective, and to some extent I will concede that it is. But I think the jury (two of them, in fact) decided that gender is a pretty big thing.

    Anyway, I think I at least partially agree with you, since I think the perpatrator's punishment should be much less.
    I don't view things in terms of simple "black & white".

    lying about your sex is different than lying about what you had for dinner with regard to sexual interactions. Android pointed out can't have sex with someone diet and you can't have sex with someone bank account you can only have sex with people.

    The only similes you could muster is that of a naive prostitute, and the person who's neurotic about diet but not who she sleeps with.

    Which is no different if the lie is physical or mental. She mentally believed one thing without any physical proof of the other.gullibility doesn’t make one a victim.

    It does in the case of fraud.

    I've read of cases of the US getting individuals extradited from Jamaica and Nigeria because they tricked extremely gullible seniors in mental decline out of all of their savings.

    It does not matter at all to the woman whether the man is rich or not, unless you're talking about what he's going to give to the woman. In which case it is not an issue of actual sex but of prostitution, and the government is not going to protect or condone that.

    I personally think a man lying about being vegan could be a mild form of sexual violation, but that is so ridiculous no one thinks the government should get involved in that.

    Yes, it could be. Although that would be a very borderline case, and in this political/social climate it would probably not happen because people are so opposed to "racism" of any kind.

    A black man and a white woman victim who could get pregnant might be a better example.

    Like you expressed, this does create kind of a slippery slope.
