    NJ Robber Dies After Trying to Steal Phone from Former HS Wrestler


    A Newark man died after a tussle with a former high school wrestler he tried to rob early Saturday, NBC New York has learned.

    Law-enforcement sources told NBC New York that 30-year-old Gian Davis approached two men near Bloomfield Avenue at about 1:15 a.m. and asked for change.

    When the men said "no," he then asked to borrow a cell phone, grabbed it and tried to run off with it, sources said.

    One of the men lunged to get the phone back and Davis put him in a headlock, according to sources. Then, sources say the other man, a former high school wrestler, pulled Davis off his friend and put the would-be robber in a headlock.

    It was strong enough that Davis apparently choked to death, sources familiar with the investigation said.


    A source said the two men called police and then stayed on the scene until authorities arrived. Davis was pronounced dead at the hospital.

    A medical examiner will determine the cause of death.

    Tom Fennelly, chief assistant Essex County prosecutor, would only confirm that an investigation is ongoing.

    No charges have been filed against the former wrestler or his friend. Their names have not been released.

    Fennelly said they are cooperating with the investigation.

    Davis had prior arrests for aggravated assault and theft. He was released from his last stint in jail on July 22.

    The victims no doubt saved the taxpayers millions in prison housing and medical costs. They should be given a medal for bravery.

    Sometimes justice is swift and immediate. I agree about the medal and it's a good thing the state did not get involved. This guy would have been back on the street robbing people within days.

    Sad that someone had to die over a cell phone. This doesn't sound like self defense to me. This sounds like someone who ran someone down and choked a man to death. Sounds like he should be charged with a crime. Obviously with a light sentence considering...but still he killed someone when he was not in self defense.

    It was more of a work-related fatality. The robber was practicing his trade and died as a result.

    Notice that the liberals are blaming the victims here for the death of the robber. This is why they do not want potential victims armed. They don't want you to be able to defend yourself. In their eyes, crime is a form of social justice. They think that crime is caused by society being unjust, so the criminal is a blameless victim. Therefore, it is wrong to kill a robber or thief in their Cloud Cuckooland world of the liberal mind.

    When are you bleeding heart libs going to understand one simple concept - if a person chooses to live the life of crime, there are consequences and sometimes their fatal.....

    Do you really think 2 men are going to tell each other "oh, we should let him steal the cell phone - after all, we don't want to hurt the thieving little cockroach!"

    And the thief's luck ran out when he chose to rob a wrestler..... you don't want to mess w/those guys b/c many times they don't realize their own strength and certainly not in situations like this...

    Being a complete moron can carry a high price and that robber paid for it. There is some concern for the man trying to get his property back, but it seems like a justifiable homicide, since he was protecting his property. However, if someone wanted to drag this to court, there is a small case, sadly. Pray for this dude.

    I misread that part. Still it should go to court. If that is true it could possibly be self defense. But a jury should decide that.

    You can't really kill someone with a headlock, it was probably a bulldog choke.
    Sad to see someone die over a phone, but that's a risk you take when robbing someone.

    If you have a fair amount of strength and have adrenaline flowing, it would be easy to inadvertently crush a person's windpipe and kill them. This wasn't an intentional killing, it was an accident.

    From the moment that this criminal attacked and tried to choke a victim, he had this coming. The wrestler didn't do anything more than the criminal did, he just did it a little better.

    The criminal got what he deserved.

    Even though I hate to say it, you are right. It doesn't sound like the wrestler was in any imminent danger of life and limb. They should have just let the guy have the cell phone and informed the police. The cops can track cell phones via triangulation of the cell phone signal even when the cell phone is turned off. It would have been recovered eventually. The wrestler could have pinned the guy on the ground instead of choking him out to death. Even though I doubt that the wrestler meant to kill the perpetrator, you take a lot of risks in mixing it up with an attacker. The cops and the courts might not always see things your way.

    Now that I think about it, it was either intentional or he had massive uncontrollable adrenaline flowing through him. A headlock is squeezing on someone's head, it is virtually impossible to render someone unconscious or kill with that, unless it's a 260 lbs MMA fighter doing it to a 90 lbs woman. A bulldog choke looks nearly the same, except it's on the neck, and it's very is to tell the difference if you're the one applying it. The dude had to know he had his neck, not his head. You also have to hold a choke a while after someone is unconscious for it to be lethal, at least over 30 seconds. It sounds like murder if he held on to a choke on an already unconscious person for an extended period of time.

    That was not the case here...Davis (the perp) tried to kill one of the victims by putting him in a headlock. The victim then put Davis in a headlock...clear case of self defense.

    Although they can, whether or not the police will actually go through any effort to recover a $100 cell phone really depends on where you are and how busy the cops are. Most police won't go through the effort to recover a stolen cell phone. They just don't have the time or manpower and are too busy trying to solve bigger crimes.

    The article says 'headlock' that is what we are discussing and yes, the robber took the risk and paid the price...end of story.
