Well I've seen studies that show there are basically 3 factors in the sentencing disparity. There is of course first the severity of crime. Next is recidivism. Unfortunately blacks are much more likely to be repeat offenders and this extends their sentence time. The third is minimum sentencing laws. These are known to disproportionately effect blacks which has led to some calling for the removal of these laws. One argument is that the types of crimes associated with minimum sentencing are the types of crimes blacks are more likely to engage in. Another factor in minimum sentencing laws is that they are often structured to get more severe for repeat offenses. And since blacks are more likely to be repeat offenders, these laws force longer sentencing for blacks.

 

Blacks like to bring up crack as unfair sentencing, since it's more of a 'black' drug. But, if you look at crystal meth, more of a 'white' drug, the punishments are exactly the same.
