    And this is INSANITY! It's beginning to resemble the McMartin trial. How on EARTH can someone who simply filmed the confrontation now be charged as an accessory to murder? How can joint enterprise apply if they merely intended to detain him for the police? I can only think much like the search of the houses the DA is desperately hoping to find some evidence of racism or to flip him against the McWilliams by offering a plea bargain? Either way this is obvious prosecutorial misconduct.

    He didn't go through the front and then appeared inside and that is pure conjecture and would still be an illegal entry.

    Why do you keep trying to excuse a criminal act simply because the guy was black?


    You assumed McMichael had the opportunity to question the white people. You have assumed everything. You just again assumed he had an opportunity to confront the white people without a shred of evidence to prove. And you've yet to explain why that would mitigate what Arbery did. We can only try to stop a black burglar if we can also find a white one to make it even, what nonsense.

    But if you're going to do a citizen's arrest it would make sense to video it for evidential purposes? Please give me any evidence of premeditation or malice aforethought for murder in this case?

    Agreed, this would not be an issue if these were uniformed police officers, I have some sympathy with Arbery despite his criminality in that he was confronted by 2 armed men who he didn't know from Adam but I also have sympathy with the McWilliams for confronting a man they reasonably suspected of being a burglar and may have been armed.

    By the evidence we have this makes no sense. Did he get in his car because he knew they were going to murder the guy? It's a shaking murder charge against the other two guys let alone someone who was about 100' back merely filming what was going on in front of him he had no control over what happened.

    My understanding is the HE volunteer the video to the police. Not someone who knowingly just committed a murder would probably do.

    He is telling me that black burglars can't be questioned unless we also have a white burglar to question too and since McMichael did not have the opportunity to question the white people who had illegally entered the house the black guys gets a bye they have to let him flee the scene. Makes no sense to me but if one is going to make it a racial issue it's not going to make much sense.

    I think that's what the DA is hoping for but unless he can testify to racist behaviour or prior planning from the accused I can't see how?

    Quite true but the robbery would be a pre-planned and deliberate crime where they would all have mens rea and malice aforethought, this is quite clearly not the case here. If you give some friends a lift to the store then one pulls a gun and robs the place you are not guilty. If your friends confront a suspected shoplifter and end up accidentally killing him in the struggle whilst you video it for evidential purposes you are no more guilty that they are.

    the attempted detention was illegal. A death occurred during the commission of a crime by McMicahels. The person shooting the video was part of that. If a death occurs during the commission of a crime, everyone involved is charged with murder.
    it's the letter of the law. We know McMichaels had no authority to detain arbery. We know they were brandishing weapons. We know arbery was killed while defending himself from the illegal detention. GA law states that if someone is killed during the commission of a crime, all parties are charged with the death of that person. There is no misconduct of any kind here.

    Whether he was guilty or not we shall never know, the truth died with him. But the grounds to suspect him were reasonable. I have sympathy with Arbery even given his criminal record but I also have sympathy with the McWilliams.
