DeSantis suspends Tampa prosecutor who vowed not to criminalize abortion

    Hmm, that does seem odd that one elected official can dismiss another elected official without some kind of trial or hearing.

    Your example above seems to be situational. Can a District Attorney just decline to enforce a law altogether, regardless of situational circumstances?

    He signed the letter before Roe v Wade was overturned. No case had been brought before him. Republicans don’t always have control and we have seen it before. What comes back at ya? Comes back twice as hard!

    I don't think he generally can, but DeSantis isn't about to let that little detail bother him.

    I think that we constantly forget that the rules about what government officials, especially elected ones, can and can't do aren't just guidelines but laws and laws have specific punishments if you break them. DeSantis needs to be standing before a judge himself.

    I'm of the opinion that you elect legislators to make or repeal laws, and you elect DA's to enforce them. Congress doesn't enforce laws, and DA's don't make them. As Alwayssa pointed out, there is a certain amount of discretion afforded to LEOs and DAs, but I don't know that it extends so far as a DA issuing a blanket refusal to enforce a law across the board. That can get very ugly if you get a DA that decides, for example, that rape is okay, or murder is okay. An extreme example I know, but one I make to illustrate that this can go any number of ways. I am pro-choice, I think the states that are banning abortion are backwards and regressive, and to be quite honest a part of me cheers when people stand up to stupidity like this DA did. But, I don't think that affords him the freedom to simply decline to do their job.

    I take the same position when sheriff's and DA's have said they'll decline to prosecute gun laws. They may not like the laws, but it's not up to them to decide what they are. That is why I pointed out in my initial post here that I hope that the folks who think it was right to suspend this DA in this situation would also agree that's it's wrong for other DAs and LEOs to do the same thing he did.

    Florida has a rape exception even though a rape victim can prevent herself from becoming pregnant but note once again you immediately throw the rape card as if all abortions are due to rape when it is only 1%. And abortion is the only law this pro-abortion prosecutor had announced he would not enforce.

    Do you believe it is up to a prosecutor to determine which laws the state will follow?

    Prosecutors do not have prosecutoral descretion to blanket rejections of the laws of the state.

    Florida laws do allow the Governor the ability to suspend but not remove. There will be a Senate hearing to determine removal.

    Except in this case he signed the letter when said law was unconstitutional.

    Ever heard of " Prosecutorial Discretion"? No, you have not.

    Prosecutorial Discretion: The decision you can make a body or officer to decide whether or not to apply the law in both civil and criminal proceedings.

    DeSantis is a lawyer, so its odd he does not know about it.

    Ft Lauderdale / Broward county is not a big retirement destination, but we do have "Galt Mile", which has one high rise next to the other and full of retirees. In general Miami-Ft Lauderdale is too busy for retirees, so they settle further North, and places like The Villages (which has more than 50 golf courses and lot of action for old people). They live it up too, and The Villages has sky-high rates of STD.

    Can people at least be accurate. In FL you still have 15 weeks to have an abortion for any reason and hopefully that will never change. That’s a long time to decide. And when the mothers health is at risk it’s anytime. You don’t accidentally realize you’re pregnant one day unless you’re horribly obese and obviously have major mental issues and an irresponsible mess. In the extremely rare case of rape it’s still plenty of time to get it done, and even after 15weeks there should be a special provision if the woman was kidnapped or held captive. But that’s an anomaly.

    I think Ron DeInsaneis wants to be POTUS. He'll make up all kinds of 'culture/woke' issues to rail against. The RW/Tea Party base simply craves it.

    Warren was a woke anti-justice American hating democrat as bad as the ones in SF.

    GOOD RIDDANCE!

    DeSantis did the right thing and it’s very popular with the people that had to suffer the consequences of Warrens deliberate failure to do his job.

    His huge win in 2016 was unexpected and a total surprise. Democrats in south Florida cheat and have for many years, Irving Slosberg was caught in 2000 with an actual voting machine in his car (That was during the Bush Gore recount).

    The Florida Constitution makes the law difficult. Right to privacy is expressly written for individuals.

    Good thing Tampa isn’t South Florida


    So basically you don’t like his politics so you’re happy he was suspended and that the will of the voters was stomped on? I can count on you to be ok when a Democrat Governor suspends a Republican elected official in the future?

    He was nowhere near South Florida, but Tampa region, which is pretty much 50/50 Dem vs Repub. He WAS an official elected by We The People, so this stunt by DeSantis is probably going to the courts. Its obvious that this lawyers biggest crime was being critical of DeSantis,

    As for cheating in South Florida, its typically the Republicans who have been caught doing it, including last election cycle.

    I hadn't heard about that, but no one should be surprised, it's what they do.

    When initially approached by the Supervisor of Elections Office and asked about the voting machine, Slosberg denied having it. On November 11, 2000, police confronted Slosberg about the voting machine which Slosberg then retrieved from his car and delivered to the police.[12] No reason was ever provided for Slosberg having possession of the voting machine, and despite additional allegations of misconduct, Democrat Supervisor of Elections Theresa Lepore neither investigated nor pressed charges against Slosberg.

    Now hang on a second, Florida's law just went into effect July 1, it's a 15 week law with exceptions. There is no criminality unless we're talking about providers offering after 15 weeks with exceptions. Does the left really want say providers offering abortion at 30 weeks???

    Sorry left, here we have a real governor, that is actually doing his constitutional duty and removing a f'ing prosecutor that literally says he won't prosecute those breaking Florida law, in essence violating his constitutional duty. I know it sucks but the left actually has to change the law in Florida vs getting Soros prosecutors to ignore the laws like in wacko Cali or NY. Bravo Gov!!!!

    1. The lawyer has not refused to prosecute a single case, so he was fired for what he might have done in the future. Basically he was fired because he was critical of the Governor.

    2. The lawyer also did not flat out say he will not prosecute, he said the law which went into effect violates Florida Constitution, which even DeSantis has sworn to protect.

    3. All prosecutors have Prosecutorial Discretion, which means they do NOT have a duty to prosecute every single case.

    4. The lawyer is a democratically elected official, to this witch hunt is against the will of the people


    Why do you ask if someone "is really saying" something they are NOT saying? Its weak, and will get called out.

    Awwww......you got called out and the best you have it to try to slap a childish label on me. LOL

    I think he can and should replace them with someone willing to uphold the law. The DA is not a policy maker, they’re not a law maker, they’re suppose to uphold the laws the representatives of the people have created. You don’t have to be right leaning to do that unless you think the left are only capable of breaking laws
