People aren’t figuring in the full implications of the last 48 hrs. The ex president is making a false claim of authority (in pectore declassification) and packaging it in a demonstrable lie (the standing order). He appears not to be getting any legal advice at all.

2/ Not bad legal advice. Any legal advice. His current lawyers are an unknown lawyer from New Jersey and a former OAN host. But it seems unlikely even they’re advising him on this. It all suggests a complete implosion and panic in Trumpworld.

This speculation about needing for the affidavit to undergo "redaction" would hinge on whether that specific document(s) contain classified information or not. Trump says the documents in question were DECLASSIFIED. Was he lying? If so, then that should be brought out to the public's examination also....

But, if Trump isn't lying, the documents, the affidavit, and everything else pertaining to this unprecedented, bald-faced raid should be made FULLY available to the public without any manipulation, deletions, or anything else by the DOJ, the FBI, Trump, or anyone else! Agreed?

:roflol: Understand the words before you use them. I can criticize the leadership of an agency, while praising the work of the foot soldiers.
Are you seriously denying that Strzok and Page (two top level FBI agents) did not conspire against a political party in favor of another?

You're constructing a strawman argument. I never claimed the "entire FBI is bad".

Present the sealed affidavit and then we'll talk.

I'm quite fine with my opinion and yours doesn't really matter. Tend to your own moral shortcomings.

Look second paragraph on page 2 of 7:

"Unless delayed notice is authorized below, you must give a copy...
...or leave the copy and receipt at the place where the property was taken.

So, no obligation to hand over anything to the lawyer!

I agree with you -- partially. And I've said all along, if Trump is legitimately charged with crime(s), then he should be given a fair trial... and if found guilty, he should be punished according to the law. I've never argued with anyone to the contrary.

In this unprecedented instance, involving accusation hurled against a former President of the United States, the case can, and will be made that EVERYTHING, including the affidavit must (MUST) be made public! After all, the guy who Garland got to authorize the raid on Trump's home wasn't even a JUDGE... he is a "magistrate". And one wonders why Garland must have had such a difficult time finding a real JUDGE to authorize this while he was shopping around for someone to do the DOJ's bidding....

If the information is a matter of national security then no, the contents shouldn’t be released.

They should simply give an indication of the level of classification.

I find it interesting that trump says both all of the files were unclassified by him but also that the FBI planted all the classified files.

Good catch... yes, it should be spelled with a "t" and not a "d". "A poor workman blames his tools", but not even my usually reliable spell-checker caught that one.

A delayed-notice warrant differs from a n ordinary search warrant only in that the judge specifically authorizes the law enforcemen t officers executing the warrant to wait for a limited period of time before notifying th e subject of the search that the warrant has been executed.

Fine. Point is, DOJ never releases the affidavit until charges are filed.
To release it earlier could compromise an ongoing investigation.

And it has been cited to you they have been there twice and inspected the doc's and instructed on how they wanted them stored. That there had been no additional request since then.

No it doesn't or that an additional request would have cleared it up. It they knew of a specific document they shouldnhave asked for it. What they did was get a search warrant foe ANY document produced during his entire term of office. Bring out the latherns and pitchforks.

You have rumor and innuendo and no evidence there has been any destruction as opposed to Clinton. Let me know when she gets the same treatment then they can go after Trump. The last stated position on suchbmattersnis the prosecutors would never prosecute such cases. What changed?

Up to a specific point, yes. But not during a search and seizure.

I posted this question about an hour ago.

"I'm confused about the boxes he had in storage and what happened between the first pick-up and the 2nd pick-up using a search warrant.

After the first boxes were handed over to the National Archives (?) were they under the assumption that was all the documents etc that Trump had in his possession?"

    Maggie Haberman

    @maggieNYT

NEW: At least one lawyer for Trump signed a written statement for the Justice Department asserting all docs with classified markings in the boxes had been returned after a June 3 meeting, which could explain why "obstruction" statute was listed on warrant

    nytimes.com
Trump Lawyer Told Justice Dept. That Classified Material Had Been Returned
The lawyer signed a statement in June that all documents marked as classified and held in boxes in storage at Mar-a-Lago had been given back. The search at the former president’s home on Monday...

Could you grant us the favor of enlightening us about the procedure that your Highness considers should have been followed; including, of course, references (REFERENCES) that support your arguments.

Could it be, by any chance, that Garland, who, if I'm not mistaken, merely authorized the request for a warrant, submitted by an FBI agent, would have left the choice of a magistrate to a local DoJ office? Or does he personally know every magistrate and judge in the country?

And isn't a magistrate good enough to sign a warrant for the search of a criminal's property?

And isn't an affidavit only served to the individual who is charged with a crime? I am not sure it would automatically be made public; privacy protection, you see.

I couldn't care less about Trump. I do care about equal justice and when I see a double standard I tend to complain about it. Democrats, on the other hand are deaf, dumb, and blind only believing what their Nannies tell them to believe.
