She is in going in civil court now, since she had no criminal case. How do you stop a rogue prosecutor if you are not a Clinton?

She's "using the words" all AG's and prosecutors use until their case goes to verdict. Fraud is one of the most difficult cases to prove, but fortunately, the burden of proof in a civil case is "preponderance of evidence", which is less much than reasonable doubt...

She seems to have that, in volume, timeframe, outside company support, and defendant(s) refusal to answer questions...

    Allege is the term used in civil cases against the defendant;;Trump.;
    Accuse is the term used in criminal cases against the defendant.;

Could very well be settled, but the price will be much more than simple money at this point..

Many of the T**** crime family restrictions to do additional business in NY are as important to NY as any financial settlement...

Don't be guilty is always best, but after that, plead guilty ASAP and/or settle a civil case..

That's what smart guilty people do....

James has over 200 examples listed that were either false or misleading on Trump's asset valuations for 10 years on his financial statements

What is the difference between “supposedly” and “allegedly”?
    https://www.quora.com › What-is-the-difference-between-...

An allegation is close to an accusation, whereas a supposition seems closer to guesswork, maybe an educated guess, but a guess nonetheless.

And again, you aren't saying anything that isn't know, and again not answering the actual question.

I didn't ask when it was used, I asked if you knew what it meant. Your weakness is showing.

Backstory on James's civil investigation leading to Trump & others being sued and her recommendations of fraud to the Fed prosecutors and the IRS.

    May 18, 2021

"Donald J. Trump and his family came under increasing pressure from New York investigators after the attorney general’s office said Tuesday it was working alongside the Manhattan district attorney in an ongoing criminal fraud investigation.

The two offices have been conducting parallel investigations for more than a year, though the inquiry by the office of New York’s attorney general, Letitia James, has been a civil one, meaning it could result in a lawsuit or fines. The Manhattan district attorney, Cyrus R. Vance Jr., has been conducting a criminal investigation, which could result in charges.

The new development, first reported by CNN, was disclosed after the attorney general’s office wrote to the Trump Organization in recent days notifying it that information collected as part of the civil inquiry could now be used as part of a criminal investigation.

“We have informed the Trump Organization that our investigation into the organization is no longer purely civil in nature,” Fabien Levy, a spokesman for Ms. James, said in a statement. “We are now actively investigating the Trump Organization in a criminal capacity, along with the Manhattan D.A. We have no additional comment at this time.”
A lawyer for the Trump Organization did not immediately respond to a request for comment, though in the past, Mr. Trump, a Republican, has attacked both investigations as politically motivated fishing expeditions. Mr. Vance and Ms. James are both Democrats."

You were replying to the article I posted that clearly said "James alleges"
Your deflecting due to being wrong is hilarious.
But not as hilarious as your "supposition"

Trump pleaded the 5th nearly 450 times.
Junior and Ivanka did answer questions, trying to avoid their 5th entering the civil trial.
Don't know if they pleaded the 5th on some questions though?

So sorry that there's a legal explication for James's civil case and suing Trump in civil court.

NY Probe Found Potential Crimes. Why Isn't ... - USNews.com
    https://www.usnews.com › News › U.S. News®

NY Probe Found Potential Crimes. Why Isn't Trump in Cuffs?

"For one, even if she did want to prosecute Trump, she doesn’t have jurisdiction under state law to bring a criminal case against him or any of the lawsuit's other defendants, including the Trump Organization and his three eldest children, Donald Jr., Ivanka and Eric Trump.

In New York, the state attorney general’s office is only allowed to prosecute a limited range of offenses on its own, like bid rigging and payroll violations.

Otherwise, the office must partner with a county district attorney on a prosecution — as James' office did with the Manhattan district attorney's office in a case against Trump's longtime finance chief — or obtain what’s known as a criminal referral from the governor or a state agency that has jurisdiction over the alleged wrongdoing.

Even then, mounting a criminal fraud case is far more challenging than a civil lawsuit".

I don't think Ivanka or Kushner pleaded the 5th. Eric definitely did, not sure about Junior. I don't know for sure the reasoning, but keep in mind that IF Ivanka and Kushner have been offered immunity for cooperating in the criminal trial, then they wouldn't be able to plead the 5th.

Some info on Junior's and Ivanka's involvement.
    Trump's appraiser is under investigation.

Ivanka and Donald Trump Jr. sat for depositions as part of NY ...
    https://www.cnn.com › 2022/08/03 › politics › ivanka-tru...

Aug 3, 2022 — Trump Jr., who runs the Trump Organization with his brother Eric Trump, did not assert the Fifth Amendment and answered the state's ...

"By answering questions, Trump Jr. increases his possible legal exposure. He was involved in several properties, including 40 Wall Street, and certified the accuracy of the financial statements from 2017 forward, the attorney general's office has said.

Ivanka Trump was a key liaison with Deutsche Bank, which loaned the Trump Organization more than $300 million.

The financial statements were prepared by accountants inside and outside of the Trump Organization. There is also debate over how the properties were valued given the flexibility over appraisals. The valuations were signed off by Trump's longtime appraiser Cushman & Wakefield, which is also under investigation.

The firm, which broke ties with Trump after January 6, 2021, has denied any wrongdoing. Banks, which supplied financing, also didn't lose any money on the loans they underwrote.
The New York attorney general's investigation is in an advanced stage. Lawyers with the office have said publicly that they expect to take some kind of enforcement action but would engage in discussions with the Trump Organization before a decision was made."

The case was dropped for lack of evidence of a crime to prosecute.

The SDNY investigated for TWO YEARS and dropped the case because they could find no crime.

AG James in her campaign to win office announced her intention to investigate and prosecute a PERSON not a CRIME which goes against our system of justice. She had the "criminal" but no crime.

    ".....
Ms. James ran for office promising to indict Mr. Trump, which is the opposite of the way justice should be done. You’re supposed to find a crime and then identify the perpetrator. Ms. James declared Mr. Trump could “be indicted for criminal offenses” and has hunted ever since for a crime to charge him with.

Her civil lawsuit requires a mere preponderance of evidence standard to prove guilt, not proof beyond a reasonable doubt. She has referred the case to the Internal Revenue Service and federal prosecutors in Manhattan, though the Manhattan district attorney didn’t file charges after examining the same issues....

...As far as we’ve seen, the lenders don’t seem to consider themselves victims. They made money on the loans, which didn’t default. The transactions were presumably scoured by auditors and bank due-diligence officers. There is enormous variability in real-estate valuations. The question Ms. James will have to prove is whether Mr. Trump’s claims amounted to intentional fraud...

...Mr. Trump has made a business and political career of getting away with whatever he can, and it’s easy to imagine he crossed a line. But the Democrats pursuing him have become Captain Ahabs bent on taking him down by any means necessary. Ms. James is a partisan prosecutor, and her charges and evidence need to be examined in that context...

Civil cases use the term "allege"
Criminal cases use the term accuse.
    Duh! Then comes the trials...

Thanks though, I'm still laughing over your claim that all James has for suing Trump is.

The fact that the criminal investigation has already resulted in an indictment and is ongoing kills the "alternate history" that the case was dropped and resulted in nothing. Anyone should be able to see that.

Yeah, but Bragg 100% dropped the ball in the main criminal case he had laid out for him by Vance and others.

Wait until someone tells them that there are at least 3 different ways to determine the value of a commercial property that can vary wildly.

Trump, his sons and his supporters are calling the civil suit a "witch hunt".
Will Trump again try to settle this "witch hunt" with the SDNY like he wanted to?:roflol:

So funny that none of Trump's supporters are questioning why he wanted to settle a "witch hunt" in the first place

5 juiciest takeaways from the Tish James lawsuit against Donald Trump

"James is playing hardball," but don't expect a showy Trump trial in this case."

"However, James’ office appears to be taking the stand that whether the banks were or were not actually tricked isn’t relevant to the legal case — that the alleged intent to deceive on the part of Trump, his children and top aides in order to get a financial benefit is sufficient to constitute a violation of the law.

James has also said that whether the other parties in Trump’s deals sustained a loss also isn’t relevant, so she can pursue these violations even if the banks profited from the deals.

James is trying to get the suit heard by New York Supreme Court Justice Arthur Engoron, who issued orders requiring Trump and his family members to sit for depositions in the probe. The judge seemed largely unsympathetic to Trump, so if the case winds up staying with him the former president could be in for a rough ride."

    Do you know if:

Bragg can interfere with James's forwarding her Trump fraud examples to the Feds and IRS to be investigated or interfere with their fraud investigation should there be one?

Did Bragg have to sign off on James's 250 million civil suit against Trump?
