You're overanalyzing. That seems to be a common lefty thing. This is a law that will punish elected officials who aid and abet criminals. If they weren't going after illegals then you wouldn't care.

Well first, suspected nullification is very rare and as far as I know there hasn't been an instance where every juror admitted to participating in it thus making it a documented case.

Second, there have been instances (supported by Supreme Court ruling) where jurors have been instructed and warned that they cannot acquit because of a belief that the law cannot exist due to it being unconstitutional - this being borderline to the concept we're discussing.

And third, in general a criminal judge in a jury trial instance isn't your peer so if that judge convicted you that would be a violation of the 5th.

So the answer is no, AFAIK.

But then that wasn't the theoretical we're discussing.

A post-acquittal motion to declare mistrial on the grounds of jury misconduct would seem to be conflict with the concept of nullification but they are different.

Because the distinction at work in nullification is that the question of law displaces the question of fact.

In your premise a full Hispanic jury wouldn't consider fact or law, they'd just see a fellow Hispanic and check the not guilty box.

So the very elements that empower the jury with final decision have been tossed and thus the process has never moved into the realm where the mechanisms of nullification exists.

Now of course proving this would be a virtual impossibility but I'm just following the theoretical you laid out which I found to be ridiculous.

Never pass. The GOP is fine with illegal immigration. Their inaction evidences that.

All well and good but what does this have to do with Libby Schaff's very illegal actions? Or are you a fan of rapists and drug dealers getting
a sign to scatter when the law is closing in?

LOL you wish for any warning to be illegal and worth five years in jail not just warning to rapists or drug dealers but warnings to the far larger number of people such as warning of raids on 7/11 stores or raids to catch mothers picking up their children from schools and such.

Nice that you can mistreated millions of honest and hard working people by using the excuse of MS-13 while at the same time spending a large percent of your resources to go after far safer targets then arm gang members.

Your attempts to trivialize the legislation doesn't really convince. What Libby Schaff did was literally criminal.

Not sure why we need additional laws specifically for elected officials. Maybe I’m missing something but unaware of any immunity for obstruction of justice based on holding a local office.

Leftists are engaged in a full-blown revolution against the United States and our sacred Institutions -- the rule of law, the democratic process, our economic system. They've been nibbling around the edges for over fifty years, but Trump...specifically the America-First platform that swept him into office...has them in open revolt.

They thought Obama was a clear indication that they'd won the war....

funny thing happened on the way to Progressive Utopia.

Yes.. I saw the "statement"... It involves a Judge who is involved with La Raza... Now i know its some other La Raza not that La Raza wink wink... /facepalm

Now why would you want a La Raza judge ruling on something that involves immigration?

And you’re underanalyzing, a defining trait of righties. This is an expansion of federal power over state power no matter how you slice it. If they were going after something you cared about, like guns, you would be having an apoplectic fit.

They might wish to stop interfering with American citizens who dare to talk to each other in Spanish as I know of no law that make public Spanish speaking a crime.

Nor do I know of a demand for them to go after harmless working Spanish people before they go after criminals such as gang members that they seems to need in the nation in order to justify their over the top behaviors.

But you right we need to removed the far right GOP congress members from congress as soon as possible.

    I'm sure they know that.
I'm sure they are going after both. Folks that break our laws and enter our country illegally clearly have no respect for us or our country.

Not sure I see the point, given 8USC§1324(a)(1)(A)(iv), under which Schaaf could be prosecuted right now, whereas she couldn't be prosecuted ex post facto under the King bill.

Yea like I said in another post we've obviously reached a point where we have to create special laws for the ruling class because the current laws we have are just for us peasants.
