    Kwoka's take, like that of so many others, begins with the assumption that the president is an employee of the federal government. Constitutionally, that is not the case. The administrative agencies, at least the ones in the Executive branch, work for the president, not the other way 'round. That being the case, the President MUST have ultimate authority over which documents he retains at the end of his time in office. He can't go back and get more stuff after he leaves office but if he has it when he walks out the door it should be his. After his time in office the issue would only be with regard to what he does with the documents.

    The Presidential Records Act (PRA) defines what constitutes “Presidential records” and what are “personal records.” 44 U.S.C. 2201. Personal records include “diaries, journals, or other personal notes serving as the functional equivalent of a diary or journal which are not prepared or utilized for, or circulated or communicated in the course of, transacting Government business.”

    The PRA also requires that all documentary materials “be categorized as Presidential records or personal records upon their creation or receipt and be filed separately.” 44 U.S.C. 2203(b). The President does not have discretion to categorize a Presidential record as a personal record


    Did Presidents before Nixon have total control over their records?

    Prior to the Presidential Records Act of 1978, which first applied to President Reagan, all of the official records of the White House were considered the personal property of the President (from Presidents Washington to Carter). Presidents Hoover through Carter chose to donate their records to NARA, along with the Presidential Library buildings where they are stored.

    While these Presidents had control over their personal papers, they lacked control over the classification status of any records that were classified. The classification status of the information in the papers remained under the control of the U.S. Government.

    The Nixon records, including the Watergate tapes, were seized and transferred to NARA in 1974 by a federal law, known as the Presidential Recordings and Materials Preservation Act (PRMPA), 44 U.S.C. 2111, note. In response to the Nixon issue, Congress enacted the Presidential Records Act in 1978 to change legal ownership of Presidential records from the President to the United States Government, which took effect at the beginning of the Reagan administration.

    And all that is a civil matter with no criminal aspect as the supreme court confirmed in the Clinton Socks case. Now all that being said, this isn't about records, it's stated that Trump had boxes moved to hide them from investigators instead simply fighting the subpoena so it's more about obstruction. They went to espionage that's used rarely in spy cases and is what's going to ruin this for the prosecution. They went for the kill shot and want the guy to die in jail, ok now if it fails this lefty all but guaranteed Trump gets reelected.

    BZZ, TRY to keep up, that case had to do with PRIVATE documents (tapes from a historian) of the DIARY type. SCOTUS never looked at it.

    This case is about Diaper Donnie's WILLFUL disregard for the return of GOV'T DOCUMENTS, SOME OF WHICH WERE CLASSIFIED, SOME NOT, but all are US Gov't property

    Here is a noble idea, win election, became POTUS , appoint AG and investigate.

    Oh , Trump did win in 2016 and appointed 4 different AG and investigated but couldn’t find anything. Trump handpicked FBI director couldn’t find anything against Biden or Hilary. Trump still wanted to find “dirt” on Biden so he went outside USA and called volodymyr Zelensky to investigate Biden. But still didn’t get anything. Oh , my mistake , trump did get one thing – “ A big bipartisan impeachment” .

    In their role as oversight of the FBI YES that is the issue they are not a criminal investigative agency. That is why they are calling for a special prosecutor.

    What FBI report?

    We already have some of the bank records and more are coming thanks to Grassley and Comer. What is the basis for your simple dismissal of the whistleblower allegations?

    Kushcher runs an investment firm and MANAGES $2B of other peoples money, it was not $2B that was given to him it is in accounts of those persons who invested and I under are enjoying his very good management of their investment. The Biden family ended up with TENS OF MILLIONS in their personal bank accounts that had originated from our worse foreign adversaries through and huge laundry of LLC's. What product or service did the Biden family provide them for those $10's of millions.

    Trump had 4 Hand picked AG of USA and hand-picked FBI director. 4 years they tried and found Nothing against Biden. Rudy Giuliani went all the way to Ukraine to find Biden's corruption and only thing he bought back for Trump was an “ Impeachment”.

    LOL tapes of a historian. Good grief hook line and sinker but a question was those his tapes or the governments? see how this work. That being said, as I have said repeatedly this isn't about the documents, it's about defying a subpoena instead of fighting it. Supposedly Trump had some moved, if that's true it's obstruction, certainly will have a hard time proving espionage and the dumb left will get the idiot elected again. Congrats.

    I realize FACTS are hard for right wingers, but yes the Clinton "socks" case was about recorded conversations (later used for a book) that Clinton kept in his sock drawer, clearly PERSONAL Documents VS Gov't docs, like a journal or diary

    A suspended FBI agent, who Republicans view as a whistleblower, told lawmakers on Capitol Hill in May about the form detailing the interview and has alleged the FBI tried to bury it.

    Why didn't the FBI want to hand over the document?

    It contains what the FBI calls "unverified" information.

    Essentially, anything could lead to an FD-1023 form, which does nothing more than acknowledge an interview took place.

    While Republicans are assuming there is a coverup, it does make some sense that if the FBI had gotten a wild claim that it could in no way substantiate, it would not want to give oxygen to that information.
