5 round magazine limit proposal

    It does not need to be stated. The united states supreme court has ruled on firearms multiple times, holding that the second amendment protects all bearable implements that a person may take up for legal purposes such as self defense. If modern firearms are protected, which they are, the magazines which they use are protected as well. Both modern firearms, and detachable box magazines are in common use in the united states, and have been round for more than a century, making them quite common.

    In the Caetano ruling the united states supreme court reiterated this point, declaring that a firearm cannot be prohibited simply because it is dangerous, nor because it is unusual when compared to what was in existence at the time of the ratification. All modern firearms, and their accessories, are protected by the second amendment. There is quite literally no legal basis upon which they can be prohibited from ownership by those who are not legally prohibited from possessing firearms.

    Where does it say that the government is empowered to regulate the number of shots in a firearm owned by a citizen? The Constitution doesn't t restrict the rights of citizens, it restricts the power of the government.

    1. requires all machine guns, except antique firearms, not in the U.S. government's possession to be registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF);

    2. bars private individuals from transferring or acquiring machine guns except those lawfully possessed and registered before May 19, 1986;

    3. requires anyone transferring or manufacturing machine guns to get prior ATF approval and register the firearms;

    4. with very limited exceptions, imposes a $200 excise tax whenever a machine gun is transferred;

    5. bars interstate transport of machine guns without ATF approval; and

    6. imposes harsh penalties for machine gun violations, including imprisonment of up to 10 years, a fine of up to $250,000, or both for possessing an unregistered machine gun.


    The "Assault Weapons Ban" restricted things legally too.

    Humans as a species is infinitely creative. Outlaw rifles shooting .50 cal BMG cartridges and somebody develops the .338,, .416, and others that have similar performance.

    The solution for interchangeable mags was developed at the turn of the century with stripper clips. And for those that don't think it's possible for the AR see the video....

    So you think you are going to DEFEAT 120 million gun owners who possess near 500 million weapons, more than all the armies of the world combined? Good luck with that...

    None of which has any relevance to the discussion whatsoever. Note the use of the phrase "in common use" in the post you are responding to. Heller, McDonald and Caetano all stated in explicit terms that the second amendment protects all firearms that are in common use, and extends to all bearable implements that one may take up for legal purposes.

    And outside of a select few states, such no longer exists, thus making it wholly irrelevant to the discussion.

    Saying it doesn't make it fact. "In common use" is unrelated to my comments. I posted what was relevant. You're not interested in truth. You just want to argue.

    What is related to your comments is not relevant. Your posts are unrelated to established united states supreme court precedent that has been set and reinforced by at least four rulings so far. Miller, Heller, McDonald and Caetano.

    Maybe the gun banners could put on their ***** hats and have a simultaneous hunger strike while holding their breath till you win.

    Apparently you haven't been keeping score, because the gun banner movement is getting it's ass kicked.

    Combined with a limit on rape and murder, it sounds like a winner. If murderers were limited to just 5 murders and rapists were prohibited by law to rape more than 5 times, we could live in Utopia! Make sure we add a law requiring home invasion robbers to stand still for 5 minutes while the innocent citizen shoots them.

    Now all we have to do is figure out how to get criminals to follow laws. Thats the east part, right?
