    So while peace negotiations plow forward, McCain steps in to stir it up to make sure war is more likely... Serving his old master again who profits when wars are going on?

    If this retired military Captain is going behind the back of his Commander in Chief as an officer of the military, should he not be court-marshaled? After all, his actions may spur our having to enter a war of untenable scope and repercussions. This is on the level of treason, sedition and mutiny folks...

    We can assume so since Obama has been all about not stirring things up and instead simmering things down there.

    McCain has always been about bucking Obama and sour grapes for losing to him. His hatred for Obama seeps between his clenched teeth. He cannot disguise it. I hardly think they're putting their heads together on this one behind the scenes.

    McCain may be a lot of things but he is not a traitor.

    If McCain is overseas acting on behalf of a US military move or anticipated move, or speaking on the military's behalf or anticipated behalf without permission or directive from his superior, then he is guilty of mutiny and sedition. Especially given the gravity of what he may achieve over there by doing so. Both are court-marshal offenses and he could be stripped of his rank or worse.

    So perhaps we should assume Obama ordered him over there to stir it up? And if not, Obama should be stripped of his rank since he cannot control his men. As acting CIC I would order my subordinate, Captain McCain, to immediately return stateside and face a tribunal for his insolence.

    You have to be a member of the Armed Forces and under the jurisdiction of the Uniform Code of Military Justice. Sen. McCain, although former military, is currently a civilian member of Congress, therefore not subject to an Article 32 hearing and subsequent Court Martial.

    The term you are looking for is "impeached."

    It seems that's open for interpretation.

    If McCain is a retired navy Captain and is going abroad even as a Senator into a military milieu, one that could result in our going to war, and acting in defiance of the CIC, his actions may be subject to military and civilian discipline. ie: he is acting as a sort of pseudo active commander/spokesman for our US military when he is in fact just one lone Congressman. His military status could get him into trouble on this one. If I was a military attorney, I'd be scouring the books for reasons to rein him in...

    Why don't we start a war just so we can draft all the Heirheads on the day they
    graduate from prep school?. Only they will have to fight in it. That's pretty much what they did to the rest of us in Vietnam.

    I disagree, because of the different standards provided in courts martial, their jurisdiction is limited to those persons and offenses the military has a legitimate interest in regulating. Courts martial jurisdiction extends primarily to servicemembers on active duty, POWs and persons accompanying the Armed Forces in time of declared war, as well as certain violators of the law of war.

    In time of war is defined under Title 10 of the U.S. code, Section 802, quoting ...
    Actually I was incorrect about a Senator being impeached...they were exempt in 1799 when they defined "civil officers" as people appointed by the US President. The Constitution provides Senators can be removed from office by other members of the Senate if two-thirds of those present vote to expel an individual.

    So Sen. McCain can be "removed."
    This is the proper legal term.

    Yes primarily. How about secondarily? If a person wants to claim the title of an officer in the US armed forces, like "Captain" of the Navy, which is a pretty high rank for the Navy, even as a retired officer, you don't go behind the back of the CIC and effectively exacerbate war in an active zone and then hold your hands up innocently when the crap hits the fan like "wha??? me??"...

    He'd better hope the crap doesn't hit the fan from his instigation or presence there.. Who asked him or ordered him to act on behalf of the US in the ME???

    Travelling with a general, officiating as a military ambassador from the US.... Seems to me this is insubordination. If the CIC did not wish this on behalf of our military plans, he should take swift action agains the rogue captian..
