Considering the justices who would be ousted from their positions should the plaintiff prevail, it is unlikely the 7 remaining justices, given the rabid political ideology of three of the remaining justices (should the two Obama appointees be recused) it seems highly unlikely this will be taken up by the court. The action is in response to two previous court rulings suggesting Californias secretary of state does not have a responsibility to verify a presidential candidates status as a natural born citizen. The USJF petition cites the U.S. Constitution, specifically Article II, Section 2, which says state legislatures are tasked with determining eligibility. Given the nations current electoral process, the court document holds these lawmakers must provide voters with a choice between candidates who meet constitutional requirements for the position they seek. I know conservatives who never gave up on 2012. Hell I know some who are still waiting on Y2k. So I'll lay money they will be doing this 20 years after Obama is DEAD.
