Biden Blocked From Undoing Dishwasher, Washing Machine Rules

    The Fifth Circuit Court of Appeals has issued a ruling on a case where numerous states sued the Department of Energy and Jennifer Granholm for new regulations they tried to force through illegally.

    Secretary of Energy, Granholm, attempted to repeal 2020 rules on the aforementioned appliances without going through the proper legal process. The 5th Circuit excoriated them for their unlawful behavior.

    Basically, they tried to limit how much water these appliances could use while ignoring the evidence that the limitations they put in place cause more energy to be consumed due to lower efficiency and new factors created by the rule such as pre-washing, post-washing, re-washing, etc. The change in the rule actually caused both more water and more energy to be consumed, but they didn't seem to care because they refused to evaluate the evidence as they were legally required to do.

    Despite the legal arguments and the DoE defending itself the Fifth Circuit Court of Appeals was still flabbergasted as to why the DoE ever believed it had the authority to do what it was doing.
    The law gives the DoE the authority to regulate "energy" defined by law as the quantity used of "electricity or fossil fuels." It also gives the DoE the authority to regulate water use in ONLY "showerheads, faucets, water closets, or urinals at point of use" because these do not use "energy" as defined by the Energy Policy and Conservation Act.

    Somehow Granholm decided that she didn't have to follow the law or follow the appropriate process to change the law. § 6295(g)(9)(B) and (10)(B) Clearly states:
    Biden's DoE has been very draconian and extremist. But this doesn't make any sense beyond virtue signaling by setting new regulations that more strict despite the evidence showing they have the reverse impact. And rather than evaluate that evidence they just completely ignored it and decided to act unilaterally against the law. Everyone can thank Louisiana, Alabama, Arkansas, Kentucky, Missouri, Montana, Oklahoma, South Carolina, Tennessee, and Utah for saving the environment from the reckless Biden DoE.

    Good. I am looking to replace my toilet with a taller one, but all the ones I can find are those god awful water saving things. It isn't like my area is a desert. We have plenty of water.

    Awesome! Thanks for posting. I've got a career in regulatory work and I have no sympathy for DOE, or specifically Granholm (talk about a skull half full).

    The road to crushing EPA and CO2 regulation continues apace. Huzzah!
