Seventy-eight members of Congress have gone to court to say that President Biden's "American Rescue Plan" is "blatantly unconstitutional" because it purports to control the decisions states make regarding their own taxes. This bill is a clear federal over reach of its powers. That some of the federal leaders are siding with the states is a positive development. I expect that the courts will side with the states on this one.
I am glad that the ACLJ is getting involved. They have a very good case about Congress over stepping constitutional bounds relating to the states in crafting this legislation.
Yep the States need to exert their authority over their own matters. States have sovereignty the Federal Government can only involve itself it those matters the States allow it to. Another reason we need to repeal the 17th Amendment and give the States back their voice in the Congress so they can stop this nonsense.

The feds have been using federal highway funds to persuade states on certain driving related issues for at least 50 years. From the national 55 mph speed limit to seatbelt laws to motor cycle helmets, to drunk driving fighting measures like you mentioned. Those though don’t commandeer state resources or fiscal decisions. The Supreme Court ruled that Congress could not compel states to spend money on Obamacare Medicaid expansion. Telling states they can’t cut taxes for four years is another such overreach.

I agree with the article on this issue completely. It states things clearly enough so that me adding my 2 cents worth beyond what I already said couldn’t make it any more clear.
So, the Fed Govt is giving the states money and they are telling them what they cannot use that money for. How is that different than anything else the Feds do?
