Boston Marathon Bomber’s Death Sentence Is Thrown Out by Court

BOSTON — A federal appeals court on Friday overturned the death sentence of Dzhokhar Tsarnaev, who was convicted of the 2013 Boston Marathon bombings, and ordered a new penalty-phase trial.

The ruling, from the U.S. Court of Appeals for the First Circuit, concluded that the presiding judge in the 2015 trial, George A. O’Toole Jr., “did not meet the standard” of fairness, because he did not sufficiently scrutinize sitting jurors for bias.

The ruling went on to say that “to be crystal clear,” Mr. Tsarnaev is still subject to multiple life sentences and “will remain confined to prison for the rest of his life, with the only question remaining being whether the government will end his life by executing him.”

A family's plea, a small little community activist group, efforts on a small scale don't get the death sentence reversed for a terrorist responsible for injuring hundreds, causing 20 to lose their limbs, and outright killing 3, due to a calculated premeditated bombing that was intended to kill as many as possible. No no, this took serious work from well funded well staffed nationally represented organization(s). Tell me America isn't suffering from a cancer eating us from within, go ahead try and tell me that.

Give the guy his freedom, release him at noon on a Saturday and give the population 24 hours notice as to when and where.

I wrote in the last reply it was you I was responding to but it wasnt.
The reasoning would still stand on who I was replying to. I know trump more than likely did not pick them just as I know the governor of Massachusetts or the mayor of Boston had any say on picking the federal judge in this case I said it more as a retort to his stupidity.


Now without really delving into the case tho I cant say one way or another if the ruling was justified especially given how wacky our court system is with technicalities.

All Supreme Court, Court of Appeals and District Court judges at both the federal and state level are nominated by the president and governor respectively.
