    The sexual offender registry is for people who have caused direct harm to others via sexual violence on the person of another.

    Its a plague. The DOI was supposed to prevent Government control (via Theocracy or Totalitarianism) by putting individual rights and freedoms "Above" the legitimate power and purview of Gov't.

    The nature of Government is to try and get that control back.

    Now we have Presidents telling us its our Patriotic duty to give up the rights and freedoms that so many sacrificed their lives to purchase.

    How is it that we turned into a nation with so many cowards ? It is not like "terror" is something new ... or the trick of using fear of a foreign threat to take away rights and freedoms and increase police powers en route to totalitarianism.

    The founders knew well these tricks.. Franklin "Those who would give up essential liberty to purchase temporary security deserve neither liberty or security"


    Compare to Obama "If we want increased security ... we have to give a little" trying to justify the NSA crimes against the electorate.

    So what is this massive threat that we should all "duck and cover" , hiding under anything we can find because the mushroom cloud is coming ?

    Ohhhh ... terrorism .. that's it. The risk of harm to a US citizen from terrorism is 400 times lower than the risk of harm from walking.

    Yet for this Obama asks us to just throw away rights and freedoms ?

    Stalin used fear of a foreign threat to institute " Security for the Motherland"
    Hitler did the same calling his program to take away rights and increase police powers "Fatherland Security"

    Bush ... lacking the ingenuity or creativity to come up with a new name used fear of a foreign threat to institute "Homeland Security".

    It became our patriotic duty to give up our rights and freedoms and accept increased police powers ... "Patriot Act" .. Obama renamed it the "Freedom act"

    What a cruel Orwellian Joke.

    Especially since Obama has been arming, supporting and protecting the same terrorists that we are supposed to be afraid of ?!

    The 15 years is just THE MAXIMUM UNDER THE LAW FOR THE MOST EGREGIOUS VIOLATIONS. He has NOT been sentenced to 15 years.

    Now that that is clear, does he deserve time in jail? They both do, they were asked by the other citizens enjoying their right to spend time on the beach with their families and little children to stop the lewd sexual behavior in front of everyone. They refused. They denied it to the police who arrived, and the witnesses and video proved otherwise. They were offered a plea bargain, they refused. So they went to trial and were convicted in 15 minutes.

    The girl will probably be given 60 days in jail according to the OP article and yes has to register as a sex offender for lewd sexual behavior knowingly in front of young children even after parents requested they stop. She might very well attempt to it again and should be kept at a safe distance from such schools and playgrounds and recreational areas and we citizens have a right to ban her from such areas. You get what you pay for.

    The guy should get 6 months to a year as a repeat offender. It is not just about this offense but he has now shown a propensity to violate the law and that has to be put down.

    This is probably very relevant:

    According to the probable cause affidavit filed in Manatee County, an officer responded to a 911 call on July 20, 2014, about a man and woman having intercourse. The caller said she “was very upset because her 4-year-old daughter witnessed the couple having sex on the beach.”

    Since they exposed themselves to an underage kid, this is probably why the sentence will be so high. And they likely won't get the full 15 years anyway.

    Ahh you don't know what you are talking she is being placed on a sexual offenders list as the law provides as well she should. So you claim men who expose themselves in public parks to little children should not be placed on a sexual offender watch list?

    We citizens find that engaging in sexual acts in public in front of children is a sexual offense and we citizens will not allow to be around children in the situations committing that sexual offense a second time.

    Quit cherry picking my posts and consider getting help from "prudes anonymous". Obviously we can ban such behavior.

    What is abject nonsense is 15 years in jail and getting put on the registry for such an offense for reasons addressed in my previous posts.

    so then the break he got on his previous felony charges, should be ignored, when as part of his probation, and stayed sentence, was they he was not commit any other crimes... we should just pretend sex on the public family beach, during the daytime, with dozens of children and families within a stones throw, watching these two go at it... is just something to be dismissed and ignored? we should completely throw out all his other crimes and stayed sentences, all his second and third chances, and we should just tell them not to do it again...

    do you get he is a multi-time criminal... who received breaks on his previous crimes if he promised not to commit anymore crimes... and here he is, (*)(*)(*)(*)ing someone on a family beach with children watching within yards of them????

    do you get it?

    he was given a chance, he was given a second chance, he was given a third chance... and now, let him go sit in prison for 15 years for all his previous crimes that were stayed if he promised to follow the terms of his parole on them, clearly he has NO consideration of others since he's committed enough crimes to be in this position... otherwise he'd just be getting 60 days of jail time like the woman, who will likely serve zero days in jail because the judge will stay her sentence...

    do you comprehend any of this?!?!? he committed all those other crimes, for which he will now pay the full sentence on... since he just can't help himself...

    That you can not figure out the difference between some dude exposing himself to a kid and two people having sex is your first problem.

    Clearly what they were doing was out of line. At the end of the day ... what harm was done ?

    Is it on the level of A) Killing someone .. B) Beating someone up so as they end up in the hospital C) Beating someone up and causing minor damage D) Slapping someone ?

    so what if a guy was in a movie theatre, sat down next to you and your children during some disney flick... opened his trench coat and masterbated right next to your kids, but never touched them and never forced them to look at him... would you think thats someone we should put on the sex offender registry list? or is this just a guy wacking off?

    I would say people who get a thrill from having sex infront of families...children included ...need to know it is not acceptable. It's sick to get off on making sure others see you have sex. How is that different from a man exposing himself in front of kids??

    No one has been sentenced yet and the article stated the girl is most likely to get 60 days. He will get months if not a few years tacked on because he is a repeat offender and it now goes beyond just this one act, he has demonstrated a propensity to disobey the law now and will we receive additional punishment to put that down.

    What's the difference in the sexual exposing? The people knew they were engaged in a sexual act in front of people and children. The people there told they could see what they were doing. What is the mitigating factor between two people having intercourse in front of a 4 year old child and the one guy exposing himself to the same child. The fact that the penis is in the vagina for some of the time?

    Well what's the physical harm in exposing yourself to a child?

    Poor argument since that's simply measuring "harm" by the amount of direct physical contact, which is a pretty terrible measure of harm. The idea that "harm" only equates to direct physical contact is pretty myopic.

    As far as the actual level, I'm not sure how to quantify it - I'd say 15 years is high for something non-intentional but on the same note the reason the guy is facing such a long sentence is also due to probation violation from a previous charge.

    I'd be in favor of dividing the sex offender registry into different "ranks" rather than having everyone lumped into the same category.

    I agree that putting an 18 year old charged with statutory rape for having sex with his 16 year old girlfriend, in the same league as a 40 year old man who rapes a 5 year old girl is pretty absurd, and should be changed.

    Not in Florida. The guy is an ex felon who has been out of jail for three years while the woman is more than likely get 60 days in jail.

    As for murderers in the United States, it depends on the exact charge. Involuntary manslaughter and negligent homicide do have some leniency, but they can serve anywhere from 5 years to 15. With good behavior, that person may serve a couple. But for 1st degree, 2nd degree, or voluntary manslaughter, it is not a couple of years. It can range from 15 to the DP on capital murder, 1st degree murder charges in some states. States that do not have the DP will either give life without the possibility of parole or simply life.

    Here is the Florida statue of lewd and lascivious exhibition behavior, which is what the couple was convicted on. The issue is where the couple committed the offense. Since the couple committed the offense in front of children under age 12, it became a first degree felony. And although the video by the grandmother who filmed the couple having sex did not show any genitalia, there were children nearby who witnessed the event with one mother filing a complaint. So, during the course of the trial, some child actually saw some part of either the maile or female's sex organs while the couple committed the act in broad daylight on a crowded beach.

    your logic is like saying we should put mothers that breast feed and show their breast and a 4 year old child sees... on the list

    I think the issue most have with this is the punishment and the being put on the list, sure it's wrong, but the punishment has to fit the crime

    It was not the fact that the guy had a criminal record to be found guilty, it was the fact that some small child saw something in a public area that accosted to sexual behavior per the Florida Statue. Having a criminal record is only factoring into the jail sentence.

    She did the American thing, she videotaped the whole incident, put on YouTube, got money, and then the footage was used in said trial.

    His offense was drug trafficking and this crime warrants the "repeat offender" rule of a different crime.

    After reading the statue, the only way to get a conviction is if some kid under the age of 12 saw not only the sexual act, but the genitalia from at least one of the persons as well who was committing the sexual behavior. If the couple did the deed at night, when no one was around, the law would not been violated.

    Clearly you did not read my post very carefully. Here is what I said: "Your OP suggests that having sex on a beach is what caused the 15 year sentence.It was actually caused by the guy having a criminal record." Now, did you see me saying that he was found guilty because of his criminal record?

    There is NO 15 year sentence. And yes his past felony conviction will add time to whatever sentence he recieves.
