federal court rules the male-only draft unconstitutional

    War is not good for anyone--but, unfortunately, sometimes there is no choice.

    IMO women should not be subject to the draft because they already are subject to the constant chance of pregnancy, which, IMO, is a life interference equal to military service.

    I see the ruling as a backhanded way to eventually make all women subject to the draft, even though only a minority of them willingly choose military service.

    We don’t have a draft any longer. This pertains to selective service registration. And it’s a correct ruling. Making only males register violates the 14th amendment.

    The draft is implemented in times of need. What do you think those lists are for?

    This is not a male, female issue. The draft itself is unconstitutional. If someone dissagrees, please cite the part of the constitution that authorizes it.

    As men make some 95% of military combat deaths in the US, would you support changes that make that figure much closer to 50-50?

    So we were always ILLEGAL during the time frames we had a draft???Can I sue???

    We don’t have a draft. We have an all volunteer army. Drafts violate the 13 amendment.

    I know of no leading legal authority to support that position.
    National emergencies supersede the Constitution regardless.
    Register or not, in time of such an emergency, men, not women, will be sent to fight, kill and even die.

    Never in US history has there been an emergency that justifies enslavement of people and forcing them to fight. Even during the Civil War and WW2, the government had no shortage of volunteers.

    Union was running low on volunteers and the draft was indeed needed to fill the ranks.

    So? Have an equal opportunity draft, if you'd like. Then put the men on the front lines and put the women in the office.

    But if this ends the draft perhaps the next issue is to challenge jury duty.

    Or they could have increased soldier pay and conditions, as well as increasing the competency of army officers. But that would mean more taxes and the rich wouldn't have that. Enslave poor people instead!

    Yep. I just cannot be done during normal peace time.
    As for the 13th, it assumes people have Constitutional rights. Not when the Military takes ownership of your body. Sorry.
    Odd the argument didn't come up in Viet Nam.
    Your Constitutional rights are based upon due process. I don't doubt the government would see the process in which the government takes ownership of your body and send you to fight, kill and even die, out of line.

    A year ago I started a thread in the Abortion section telling people this was eventually going to happen, but I was mostly just brushed off and no one took me seriously.

    It can’t be done at all.

    The military can’t take control of you. The constitution down the just go away because of war. The only thing that can alter it, is an amendment.

    The U.S. Constitution does not authorize everything that is accepted. A lawsuit that IIRC reached all the way to the Supreme Court when registration was restarted in 1980 give or take held that conscription is constitutional.

    Wrong. The draft began during the Civil War mainly due to numbers problems for the Union Army.

    And it is simply a myth that during World War Two the U.S. had plenty of volunteers. During World War Two a higher percentage of U.S. soldiers were draftees than in Vietnam.

    Quest.We have a shortage of volunteers right now.We also have a very high percentage of volunteers who cannot cut the mustard.

    I’ve debated this exact topic on this forum multiple times. The US during the Civil War barely mobilized 10% of the economy towards fighting the South. If they couldn’t get enough volunteers, the solution was to raise soldier pay and improve their conditions, while also sacking incompetent generals who thought they were still fighting Napoleonic battles with smoothbore muskets.

    During WW2, the Army was turning away volunteers en masses and stopped taking volunteers entirely by 1942. They did because the Draft was more organized and simple, not because they couldn’t get enough volunteers.

    The Confederacy instituted their own military draft before the Union did.
